    i received a letter from McCalla Raymer Leibert Pierce, LLC *************************************************** claiming a owe them a debt. I do not know who this company is or do i have a contract with them. I dispute the validity of the debt you are attempting to collect. Under the Fair Debt Collection Practices Act (FDCPA), you are required to provide evidence that I am responsible for this debt. Please provide the following documentation:A copy of the original signed contract or agreement that created the debt.A detailed accounting of how the debt amount was calculated, including principal, interest, fees, and any other charges.The name and address of the original creditor if different from the current creditor.Verification that you are legally authorized to collect this debt.Furthermore, pursuant to 15 U.S.C. 1692c of the ****** I hereby request that you cease all communication with me regarding this debt except for the purposes of providing the requested validation or notifying me of specific actions such as legal proceedings. Any further communication that violates this request will be treated as harassment and a violation of my consumer rights under the FDCPA.I also believe that sending this letter to me constitutes an invasion of my privacy under 15 U.S.C. 1692c(b), as I did not give consent for my private information to be shared or used in this manner. The letter may be viewed as harassing and intrusive. If this continues, I will consider filing a complaint with the ************************************ (****) and pursuing further legal action.

    McCalla Raymer Leibert Pierce LLC (MRLP) Response: We appreciate the ability to respond to the borrower on the complaint. This loan went into monetary default for non-payment and the loan was subsequently referred to our Firm to commence foreclosure proceedings. The borrower executed a Note and Security Agreement which evidenced the loan to our client.  The Security Agreement provides that if the loan is not paid timely, then the lender has the authority to initiate foreclosure and sell the property in a foreclosure sale.  It is not accurate that the consumer is being harassed.  We are hired by our client to file a foreclosure action against the property only which is an in rem action.  The Firm is in the process of sending correspondence directly to the consumer as it pertains to the verification of the debt.

    A scheduled foreclosure sale date based on the default under the terms of the loan is currently pending.

    I've had funds held up for more than a year because of this law firm. They do not respond in a timely manner. My initial call was met with unnecessary hostility from a secretary who continues to dismisses me when I call and ask to speak with the lawyer who is handling the case. I then received an email from the lawyer handling the case saying she will only communicate ti me via email after the aforementioned interaction. These funds have been on hold for 18 months. I am going to file a formal complaint with the ***********************, because this is unprofessional. I have done nothing but provide what was asked and be patient. Also apparently they can hold these funds for an indeterminate time period which is ridiculous.

    I am rejecting this response because:

    This is a lie the home was already sold at foreclosure. I know this because I was there to purchase it. The house has also already been resold to a new owner in December of 2023. Please refer this interplead this matter to the court. It does not take a year to get in touch with the consumer.

    This lawyers office apparently exists for debt collection. My brothers property has been in pre-foreclosure. We have received the payoff amount from the finance institution that has cooperated with my bank and we are ready to pay off the debt so that my families land does not go into foreclosure and sold outside of our family. We have been trying to contact the attorneys office via the bank manager, the title company, and we ourselves personally. They do not return calls and they will not cooperate. The foreclosure date is for December 28 tomorrow. We have been desperately trying to work with them for the past two weeks and they do not want to respond. We question whether or not they want to go into foreclosure so that they can sell the property for a higher price and once they pay off the finance company, they can pocket more money. Not sure this might be the case but it seems thats how collection agencies work. This is caused our family a great deal of stress and is continuing to get worse as the clock ticks on. We need help! If someone could contact me as soon as possible it would be greatly appreciated. Thank you so much for your time.

    Received a notice on June 16, 2023 dated June 14, 2023 stating that I have until July 19, 2023 to dispute a debt. However, today July 3, 2023 I receive a NOTICE OF NONJUDICIAL FORECLOSURE SALE dated June 28, 2023 (2 weeks from 1st notice), with a foreclosure date of August 02, 2023. McCalla Raymer Liebert Pierce, LLC did not allow the ample time by law which is 30 days for me to respond to their initial notice which also stated that I have until July 19, 2023.

    McCalla Raymer Leibert Pierce LLC (MRLP) Response:  We appreciate the ability to respond to the borrower on the complaint.  In the complaint submitted to the BBB by ********************************, the borrower is claiming a sale date was set before they had 30 days to respond.  The fair debt notice sent to ******************************** dated June 14, 2023, outlines that the law does not require that we cease steps that are not considered debt collection activities, which may include steps leading to completion of the non-judicial foreclosure. 

    Please be advised that our office is proceeding accordingly with a non-judicial foreclosure that is scheduled for the ************* in August 2023.

    My father passed away in ************************************************************************************************************************************************ i had a check in the amount of ***** and change and needed copies of his death cert and my sisters death cert which i emailed over to them never heard back sent many emails to the layer who reached out with no response in return The Lawyer name was *****************************.

    The borrower was deceased (DOD 2/5/2018) and was divorced when he passed away with two children, a daughter (********) and son (*********************).  ******** died on 1/3/2019 and she was divorced at the time of her death.  She had two children who were minors at the time of the ** sale in 2018.  One of the children is now an adult (20 years old) and the other child will be 18 years old on 11/3/2022. They will be of legal age to sign the Hold Harmless Agreement so we may disburse the funds without a conservatorship.  A conservatorship process for the minor children would have been time-consuming and expensive for the family.  The firm will send the documents to children now for their execution. But the documents may not be signed until after 11/3/2022.  Once signed and returned to Attorney *****************************, then the funds will be disbursed to the family.
