      During a court hearing on 8/2/22 where Heritage was attempting to wrongfully evict me in violation of terms of the lease, the Manager ******************* made 2 false statements under oath in an attempt to create doubt around my credibility to the judge. She stated that I told their office mgr. that "I refused to pay rent" - this was never stated by me at anytime. Secondly, she stated she had "proof" that I signed for a certified letter that was returning my money orders for July rent. I reviewed her document and it was obvious that it was not my ************* advised the judge of this. After contacting my local **** they advised me their records actually indicated the letter was not delivered to my home and they are actively investigating this (trying to find out who signed my name, etc). After receiving the courts decision, which ruled in my favor (Heritage was violating terms of the lease) I then received a 60 day notice to vacate - this seems to be out right retaliation due to the ruling in my favor. I have been battling with Heritage since 2020 due to Covid - despite the Moratorium protection Heritage kept pressing to get an order to evict me. At the beginning of March 2022 there was an eviction attempt (sheriff showed up) after I was unable to attend a hearing Feb 19, as I was at hospital with my child who had covid, despite submitting proof of such and despite sending proof that DCA was going to be paying off my balance even though. There was a slight mix up with DCA making my final payment but I immediately started working to resolve the issue so ****************** & the sheriff spoke and agreed to allow me time to resolve the error - which I did. This resulted in Heritage receiving all past due payments ******************* has made several comments in various court hearings that would infer she did not believe anything I was telling her and would always try to push for the judge to provide court order to evict me. I will be contacting courts to see what can be done.

      During the hearing on 8/2/2022 Heritage Home Rentals appeared in court on behalf of the owner.  I, ******************* did not make any false statements under oath during this court date or any other court appearance. We provided documents for all communication between management and the tenant. The tenant stated she had not received the letter with the money orders for the return of the July rent. We submitted the **** Tracking Document to the court to show that it was mailed via certified mailing with tracking and signature receipt.We have not received any documentation from the tenant of the correspondence with **** regarding delivery of certified mailing to an incorrect address. Hopefully once the investigation is complete, the money orders for July rent can be reissued.Heritage Home Rentals was not in violation of the lease in this court session,nor did the court indicate any violation.  We filed with the court for clarification regarding a rental increase and the court ruled to keep the rent at the same rental rate as per the original lease since a new lease had not been signed and there is an auto renewal clause in the lease.  

      Since 2020, we have been in court several times with ************** regarding non-payment of rent since the tenant has been unable to pay rent and DCA has experienced many delays in finalizing assistance due to overwhelming demand. Unfortunately, the Covid Pandemic effects tenants and owners and creates a hardship to both parties. The owner and Heritage Home Rentals are sympathetic to the tenants situation. We have worked diligently with DCA on behalf of the tenant even after DCA indicated they had exhausted all funds available for the tenant. We have not received the misplaced July rent reimbursement or the August rental payment from ************** as of today 8/27/2022. The owners expressed their desire to not offer a renewal at this time so we sent out the notice to vacate as per the lease.
