    Seeking Resolution for a refund in the amount of $700.00 back from this company for egregious misrepresentation of services rendered and unlawful deductions from security deposit.We broke our lease early and in doing so were told that we would pay a $100.00 advertising fee every 30 days (a month) they needed to advertise the house. When asked for links to the advertising sites where our home would be posted and receipts for the $200 we were charged, we were told to check their company website, indicating that in fact no advertising of this property was done. The house became vacant on Tuesday, July 25 and removed from their website on Wednesday, August 2, a total of 9 days. As the house was posted on their website for free and only up for 9 days the $200 charge is both not consistent with the 30days requirement and an egregious misrepresentation of services rendered. We are disputing the $300.00 deduction for excessive cleaning fee and $200 deduction for palm removal from our deposit. We paid a professional agency to clean the entire house including the appliances and for an extra week of lawn service to ensure no chargers were incurred. Invoice attached. Pursuant to ******* rental property law Cleaning costs can only be deducted from the security deposit if the necessary cleaning is excessive and the condition the apartment has been left in is worse than can be reasonably attributed to normal wear and tear. As the house was professionally cleaned prior to move out, and not left in a condition worse than can be reasonable attributed to normal wear and tear we are disputing the $300.00 charge from our deposit. The palm removal charge is for something that happened during a rainstorm after we moved out and prior to their inspection something both beyond our control, has a free method of removal per waste management guidelines, and unlawful to deduct from the deposit. They have claimed the enclosed 3 pictures as proof the house was needing excessive cleaning.

    I'm seeing a trend here although it may not be rscial just that they are a bad company all around. My husband and I applied after viewing a property and were told there was only one application as of that morning but that they go in order of most qualified and not order received (told to us by the agent that showed the home.) We applied on a Saturday. On the following Monday I received an email requesting more documents, that I sent. I reached out to my landlord and previous landlord to advise to be on the lookout for rental verifications. On Wednesday of that week they asked for additional pay stubs for my husband, which I sent right away and followed up to make sure rental verifications were received and they got the previous but not current. I followed up with my current and there was a typo and resent. By Thursday, they had e everything they needed. I was told it was sent over to the broker and we should be hearing soon. That was around 1pm on Thursday and I followed up first thing Friday morning and was told (in an email) that the property we applied for was already rented and that we could transfer our application over to another property for the next 30 days. Then today, Monday, I get an email saying I was denied due to credit. The Experian score they had was significantly lower than what I was looking at on my own credit report. I then called the company that does their checks and was told I was not declined due to my credit score and that was not my score but that their determination and it was because of open accounts. We met all their requirements of score, rental history and income. We had also just recently been approved for a mortgage but due to an unexpected relocation due to my husband's job, we had to switch gears and said we'd rent for a year then revisit buying. I sent over a copy of my report from before the pulled, the day after they pulled and from today; all showing higher than what their decline letter said.

    Our Rental Application Policies and Resident Selection Criteria states the below regarding situations involving multiple applications as well as credit, specifically scores below 600:

    1. Applications from other Applicants are accepted until an application is approved. Because of the fiduciary relationship Real Property Management & Realty has with Landlords, if more than one application is submitted before approval can be achieved, than the most qualified Applicant will be approved for placement. Remaining Applicants may be considered for other properties available from Real Property Management & Realty at ******************

    3. A separate application is required for each adult, eighteen years of age or older, intending to occupy the property. Each application must be filled out completely without blanks and signed by the Applicant. Full name of all occupants, animals, all vehicles and any water-filled furniture must be on the application. A credit report from a national credit reporting agency will be obtained on all Applicants. Items including, but not limited to: judgements, collections, slow or late payments will be considered. A credit score below 600 may be cause for rejection. Your credit score is just one of the criteria used. Incomplete applications will not be processed. Complete applications include: "Rental Application Policies and Resident Qualification Criteria", "Rental Application Disclosure and Authorization", and "Rental Application."
