My issue started w/ First Infinity July 2019 when I received an unsolicited phone call from Dylan S**** explaining to me how I qualified for their services based on predatory lending laws. I happened to be vulnerable financially as my husband was out of work. My credit score was 740 and my husband's higher. Both of us had always paid our bills. Due to our needs w/ him searching for a job I listened to what Dylan had to say. I thought it was a scam. So I did my due diligence and looked up the company to see if it was real and what exactly predatory lending was and it seemed legit. I was told my credit would fall about 100 points and would recover in about a year. I was told First Infinity would be in constant communication to help me get rid of this credit card debt. I was assured it was NOT bankruptcy and I would not be harassed, lose my home or car. I was told to pay them $10,000 (and I could wrap that up into the credit card debt that was at $26,00 then making it $36,000) and they would handle it. I had to agree to participate in credit monitoring by Privacy Guard for $20/month until case closes. I have NEVER received a phone call from them and have had to initiate any conversation. Even emails I had to call and make sure they got them as many they did not confirm receipt. It was my responsibility to IMMEDIATELY send them any mail I may get about my stopping payment of my debt. I held my end of the deal forwarding ALL documents including legal paperwork that I did not understand. They refused to call me back and I have made countless attempts to get to the right person. Amanda W*****, Audrey B****, Gretchen S*******, Katelyn P****** to no avail. I sent certified letter to the owner Anthony G**** (signed for Feb 4 2022) and still no call. I was served papers by local police. I am trying to refinance my home and found out I have a judgement for $36,000 against me so I can't until this is paid. So I have been given every excuse and am further in debt.

      Business response

      05/03/2022

Business Response /* (1000, 6, 2022/03/07) */ ***** ****** received her personalized client agreement on 7/10/2019 via DocuSign and was instructed to review all 8 pages and only sign and return if she wished to continue enrollment with First Infinity Financial. (Please find attached the Certificate of Completion from DocuSign detailing the date Ms. ****** reviewed and completed all signatures on the client agreement.) At the date of enrollment Ms. ****** carried a total of $29,138 that required assistance. The client's claim of $26,000 is incorrect and balance statements dated July of 2019 can verify this information. Since the signed agreement was received by First Infinity Financial, the company has completed its Scope of Engagement. This completion can be verified via the documents Ms. ****** has provided the company. Ms. ****** has been informed that although her term of agreement ended in July of 2020, First Infinity Financial, in good faith has not only continued to provide services but has also offered 2 separate refund options which were calculated to allow her to complete the program in better standings than when she entered the program. Ms. ****** has voluntarily declined both offers First Infinity has made to rectify her complaints. At this point in time Ms. ****** continues to decline multiple offers the company has made which does not allow First Infinity Financial to complete the consumers desired resolution. Consumer Response /* (3000, 8, 2022/03/13) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am not pleased with First Infinity's (FI) response. I have requested them to give me the exact charges they added to my credit card before they took over handling my debt for me. I was never informed that the debt would not be cleared and only that this was not like bankruptcy as it did not follow you as such. I was told what predatory lending was and that was illegal on the part of the banks for over loaning. So my total debt on the one credit card was $29,128. They charged me a fee of $9200.00 for their services to clear my debt. They told me they would max out this card and had me open another so they could complete that 9200.00 fee. So they did that and then rolled it all together to be handled as the predatory lending. As you can read in the documents I was to send them promptly any mail I received concerning this and their legal team would consult the collection law firm on my behalf. I did my part and they never initiated any communication without my calling them. I repeatedly asked for their legal team to explain these papers sent to me. They would just tell me not to worry they were working on this and the banks were only trying to intimidate me. As the 12 month term approached nothing had been resolved and they blamed it on covid, the collection law firm etc. I suppose they were just passing me off to ride out 12 months. So the co tract has in quotes the "validation, reduction or adjustment" of my issue. Never ever was I told I would pay them, ruin my credit, have a judgement placed on my home , and they would still not be able to help me. Tell me WHO would sign up for this! It was a total scam. Feels like child trafficking where they lure you into how easy this is and then they screwed me. They did offer me first 4000.00 to console me and then 6200.00. They said they could not send me a check until I revoked the BBB letter. Now I am on to them. First that left me nowhere but still in debt with ruined credit and a judgement on my home. Not at all what they sold me. As if 6200.00 fixed anything. I am still in the same debt. And do I really think at this poi t these liars would send ME money anyway. I do not want anyone else to be in my shoes so I will not revoke my BBB letter unless they satisfied the job they said they would do. They reduced nothing and they claim "she is in better standing than I was before entering their program"! I would mark this resolved with a satisfactory offer. This is not acceptable. I think the whole contract was a misleading scam as this is NOT at all what I was sold. The.cinversations were all recorded and I even asked would a lien be placed on my home and was told no! FI would have to pay my debt before that would happen. They flater out assured me of this. There are also calls made and recorded by the collection law firm with them posing as me trying to negotiate the debt down!!! It was NOT me and they deny doing so....as if anyone else would be doing that. I will try to attach their email telling me I had to remove my BBB complaint before they would repay me any amount. What a joke. 6200.00 is not worth my being heard by others thanks to the BBB. Business Response /* (4000, 12, 2022/03/24) */ Once again, ***** ****** has been offered multiple resolutions to this matter and has declined all options just to continue expanding this complaint that the company has attempted to satisfy. Ms. ****** has stated that her reason of complaint is due to her attempt to refinance her home which she was NOT advised to do so by First Infinity Financial, the company requests clients to temporarily withhold from using their credit until the program is completed but Ms. ****** went against this clause which was included in the agreement she reviewed and signed. Ms. ****** has explained her desire to refinance her home against the company's guidance in a certified written letter where she states she enrolled into the program during financial turmoil which allowed Ms. ****** to qualify for assistance. Per a recent conversation with the office she stated her spouse is now working and in a better financial position but is now requesting the company to refund for her enrollment since 2019. Ms. ****** is stating that the total debt when enrolled in our program is incorrect and was much higher than we stated which would mean the company was given false information as to how much was owed on the accounts. False information would also be against First Infinity's initial agreement. First Infinity has given Ms. ****** options to assist her but she refuses to take any of the options which once again, leaves the company without the ability to resolve the matter. We strive to keep all our clients satisfied but Ms. ******'s complaints only came well after the term of her contract and scope of engagement. First Infinity continued to help Ms. ****** after her term in "good faith". Consumer Response /* (4200, 19, 2022/04/10) */ Sorry for the delay. I have been on a cruise boat without internet access. I am tired of the lies at this point. They can get in a battle of exact numbers etc. to make the company sound innocent and me guilty if they want to do so. Bottom line is they solicited me explaining they would rectify this debt due to the bank's predatory lending that was "illegal". I paid there fee of approx $10,000 by maxing out that credit card and then opening another to complete the total 10,000 all to be wrapped up by them and get rid of my debt. They promised this was legal and it would hurt my credit for about a year. If they would like to pay attention to their recorded conversations with me (which I sure they have deleted due to my complaints) they will even hear my panick when I asked them if there would be a lien against my house or car and they adamantly stated no and that First Infinity would have to pay the debt off before that would happen. They never discussed the 120 days is up and only assured.me they were delayed with covid and the banks were getting harder too because of losses with covid. They continued to have me send any papers I may have received about the debt by collections to them and I did so immediately as asked. When I initially started the process, yes they did ask me not to open accounts at that time of course. However, three years in I have to move forward in my life and when I tried to refinance my home then and only then did I find out that indeed I did have a judgement against me. Otherwise I would have never known. So ultimately they did not handle my debt, only added to it by their fees. What they tried to console me with was by refunding part of there fee...initially 2600.00 and then 6000.00. This would only be given if I first revoked my complaint to the BBB. They said they could not cut me a check with a current complaint. I did screenshot a portion of that email to the BBB. I would have no way of knowing if they would actually be truthful and send it anyway as they have misled me this far. So 2 low ball offers does not constitute their saying that I refused "multiple" offers nonetheless them telling me they would not send it with an active BBB complaint. That is not honest. So end the end I now have ruined credit, more debt, and a judgement against me. That SHOULD be noted with the BBB to warn others of this company. So again they can make me look bad all they want. This is the truth. They tell me now they are no longer allowed to communicate with me and they have refused to give me any exact numbers. They did not respond to my certified letter so I moved forward with my BBB complaint without any regrets. Thank you, ***** ****** Business Response /* (4000, 21, 2022/04/21) */ This case has been closed due to the client's desire to continue with the complaint instead of taking the resolution offered. Again, ***** ****** breached the agreement that she reviewed and signed on her own free will. First Infinity continued to work in good faith with her as a client disregarding the breach and expiration of agreement. The company has attempted to satisfy this case but once again the client prefers to continue the complaint instead. First Infinity has no choice but to close this complaint. With many satisfied clients we regret this resolution.
