      New build home contract purchased from Domaine Homes in January 2022 with an expected closing of June 15. The build has been a complete disaster with multiple issues. Domaine is able to use their own inspectors by ******* law to circumvent actual reliable practices. The construction manager who was assigned to our case did not perform any supervision and was fired for incompetence yet our build was ************** structural and cosmetic issues. We cannot move in to this home after all the numerous issues but the company is refusing to return our deposit in good faith even though they have acknowledged that this home has had a number of issues and this is not a standard experience for a new build. Currently they are having to reframe portions of the home. There are cracks in the foundation. This home does not meet the Residential Construction Performance Guidelines which is a very basic and low standard. There is no time table for when the home may actually be completed. We have spent thousands on housing to try and live until we can move into the home. Their ads state they are a premium home builder with high end fixtures but this is absolutely not accurate and they are using these lines to expand to *******. They are listed as "Best of the Best" for *************** but there is no one in ***** who actually recommends them and I am convinced this was a paid title and not actually earned. You will be hard pressed to find anyone in the greater ***** area who would recommend Domaine homes including all realtors.

      In response to "Domaine is able to use their own inspectors by ******* law to circumvent actual reliable practices."  Domain Homes utilizes a private provider inspector and performs all inspections in accordance with ******* Statute 553.791.  The statute does not allow us to "circumvent actual reliable practices" and has stringent guidelines laid out within the statute that we cannot deviate from.

      In response to "The construction manager who was assigned to our case did not perform any supervision and was fired for incompetence yet our build was ************** structural and cosmetic issues."  Reasoning for the termination is being assumed, any internal employee dealings are kept within the company and not discussed with our customers.  The claim that there are "many structural" defects is based on opinion.  In response to the two specific items described in the complaint, "Currently they are having to reframe portions of the home. There are cracks in the foundation."  As explained at an in person meeting, Domain Homes is reframing some window returns for aesthetic purpose to square up the reveals, this is not structural repair.  Furthermore, the cracks identified "in the foundation" are in the slab and were deemed as normal shrinkage due to the dehydration of the concrete that can cause random cracking in concrete slabs.

      In response to "This home does not meet the Residential Construction Performance Guidelines which is a very basic and low standard."  As stated in the previous paragraph Domain Homes meets all guidelines, and to say they are very "basic and low standard" are based solely on the customers opinion and expectation.

      In response to "There is no time table for when the home may actually be completed. We have spent thousands on housing to try and live until we can move into the home."  Domain Homes has taken many steps to to help with our timelines.  Domain Homes is empathetic with the ******'s in this scenario, the latest estimate for completion is 9/15/22, which was communicated in person with the ******'s.  Domain Homes and its representatives are currently working diligently to achieve that stated date.

      In response to "Their ads state they are a premium home builder with high end fixtures but this is absolutely not accurate and they are using these lines to expand to *******."  Domain Homes has partnered with established brands to provide quality materials that also meet design demands of our customers.  We offer several options through our design center.  Many selections were chosen prior to contracting, but customer had selection sheet and signed off on those selections in January at time of contract.

      In response to "They are listed as "Best of the Best" for *************** but there is no one in ***** who actually recommends them and I am convinced this was a paid title and not actually earned. You will be hard pressed to find anyone in the greater ***** area who would recommend Domaine homes including all realtors."  Domain Homes has been building homes throughout ***** since 2010 and has many satisfied homeowners and have many realtor partnerships throughout the Tampa Bay Area.  "Best of the Best" is based on voting of the public through social media campaigns.

      Domain Homes has attached the warranty that we provide to all of our customers for reference.  Domain Homes has experienced delays throughout the build, that have been consistent with broader industry delays.  Domain Homes understands and empathizes with ******'s in regards to delays.  Domain Homes is addressing all issues they have brought up and have not finished the construction.  The deposit is being retained because Domain Homes as the seller has lived up to the contract and has worked in good faith trying to meet the expectations of the customer as they have presented them, alongside our own process and procedures.
