    Fitsmart is a company that will go into a gym and advertise "16 week weight loss challenge". They had a representative ********* sit down in front of a group and get everyone motivated on 12/7 to join a weight loss challenge for 16 weeks. We were each given a clip board with the contract for the 16 week time limited weight loss challenge that we were asked to sign. We were then asked to come up front to the Representative ********* and have our credit card for billing of the weight loss challenge. The form was filled out and only the bottom of the form was shown to pay for the challenge. Two days after I went to the gym and reviewed the contract again before entering the gym. It was at the top that the monthly gym membership was mentioned. I spoke to gym staff at *************************** and told them what happened and I wanted out of the contract and my money returned. ********* was still on-site and offered to pull my paperwork and end contract and refund my money. Of course this was not done and now gym membership I can not cancel. I have contacted the gym and they are less than concerned about the pretense that these contracts were signed under. I will file complaint for the gym under separate cover.

    I signed up for the 16 week challenge. I completed the program. Had instructors initial my attendance. WS not informed by the guy who signed us up or the instructors that times were required. Just initial our attendance dates. anyway I sent in my certified letter only to start getting notices of balance due of over $400+. I have attempted to make contact and sent correspondence explaining I was only doing the 16 weeks and done. The guy who signed us up explicitly indicated we did nit have any obligation outside the 16 weeks. So now Im fighting a credit issue and being harassed by this recovery company. The gym where I signed up is saying they were not even part of the program other than allowing us to use their gym, but they were the ones facilitating the program. So go figure! This is a scam and needs to be investigated.

    This customer is giving very inaccurate information.  She did send a certified letter as requested, but did not include her attendance record showing she did meet the attendance requirements of the 16 Week Challenge. The letter was postmarked 4/5/23 which was over a month after her Challenge end date of 2/27/23.  She was notified that her cancellation request was denied on 4/24/23.  She has not attempted to contact the billing company or us.  The billing company keeps automated logs and records all phone calls and after reviewing their records show no communication at all from this member other than the letter she sent.  She admits getting notices of the past due balance (with contact information), but again, did not contact the billing company.  The 12 month agreement with the option to cancel after showing successful completion of the 16 week Challenge is the accountability part of our program.  This way, if you complete successfully, you can cancel without issue upon submitting your attendance.  Or if you choose to continue the fitness journey, you have locked in the discount price for 12 months.  For those who do not successfully complete, they still have the opportunity to meet their goals as they are still members of the gym for another 8 months.
