      On November 20, 2022 I contacted you *************************** from Mistergetmoneyinc DBA Mister **** mover about picking up one of my ****s in ************* and bringing it to Long Island ********, He personally guaranteed it would be done by November 28 or November 29, (we have the original correspondence).I of course gave him the contact information for both Marinas so that he could set up a pick up and a delivery to each ******* When he contacted the ****** in ************* he was informed that he was not able to pick up the **** because he did not have a trailer suitable for that job in the ****** that it was Stored in. He found this out after calling the ******. He notified me of this and said he would return my deposit. I had originally sent him the $2000 deposit that he asked me to a Venmo account not in his name but in the name of *********************..I did and have the transaction saved. I had to call him many times but finally on December 4th. he sent me back $1000, there were countless reasons why he couldnt do it right away He was on a cruise for his birthday, there was a mixup in accounts, ***** wasnt working for him And so on and so onbut at least 1/2 was rightfully returned. On December ***************************************************************************************** the other $1000 back That has never happened he has not reached out to satisfy this delinquency and apparently has no intent to refund our deposit.Once again I have contacted him over and over and have all correspondences to prove this. The Better Business Bureaus primary purpose is to make sure things like this dont happen to customers. ***************************, Mister *** ********** DBA a Mister **** Mover This a prime example why the people of this country need oversight and assistance when they are being taken advantage of and hopefully the Better Business Buro, BBB, can force companies like this to do the honorable thing and stop scamming the public without having to take it to the court system for justification.We are looking for our final $1,000. Deposit to be refunded and be done with this nightmare of a company.

      Refund policy:
      Misterboatmover will offer a refund if your boat cannot be transported, if it is misterboatmovers fault. 
      However, if you the customer, your boat buyer/seller, your contractors, your agents, your boatyards and/or ******s are at fault and the boat cannot be transported then we will not offer a refund of the initial payment. Misterboatmover is providing you the right to our time, efforts and valuable transport equipment. Misterboatmover will attempt to reschedule the transport, additional cost could be incurred.
      If we gave you a flat rate quote, we will do everything possible to complete the transport for the quote and the contracted amount per the transport agreement, unless you change the scope of the transport. If you change the scope of the transport after we receive the initial payment, we will discuss and requote the transport.
      We also do not offer refunds due to:
      1) changing the scope of the transport be it routing, pickup and delivery locations, pickup and delivery arrangements, boat specifications, etc.
      2) either you or your ******s, boatyards, agents or contractors and/or the boat sellers/buyers of the vessel cancelling the transport
      3) the customers ******* boatyard, agents, contractors, and/or the boat sellers/buyers of the vessel will not or cannot perform the work required in order for the vessel to be transported.
      4) the project takes longer than originally expected, through no fault of ours or acts of God.
      Our customers are responsible for reading and understanding the refund policy as well as their
      Transport Agreement upon contracting any and all services from Misterboatmover 
      Please, verify your boat specifications, weight, trailer road worthiness (if applicable), and loading/unloading facilities (if applicable) and Misterboatmovers access to the boat prior to making your initial payment.
      Once the boat is delivered (or in some cases at pickup) all transport balances and any additional cost as described in your transport agreement are due, regardless.
      our trailer wasnt the problem the ****** specifically told **** that he needed a hydraulic trailer due to the fact that the ****** ***** have any room for their **************** to load a truck with 53ft trailer attached its winter time and all the boats are pulled out of the water and stored on their property making it very difficult to maneuver and load a large boat **** was warned by ****** and given several transporters numbers to contact that had a hydraulic trailer available he decided not to go with ******s option and hired me instead knowing the size of my equipment and knowing what ****** ********** said after I spent my time,money on fuel and put wear n tear on my equipment traveling to *************, to pick up his boat I was told that I couldnt be loaded from the kindness of my heart I decided to refund his deposit even though he signed a contract that stated deposits are non refundable i was having trouble with ***** sending from a business account to his personal account so I sent him $1000 back from my personal account and told him I would send the rest once I transferred money from my business account to my personal account transfers take time usually several days because theyre done by ***. He was calling me every day starting at 6 AM threatening me texting and calling nonstop until he decided to post some nasty stuff about me on social media that was the straw that broke the camels back I decided to invoke my companys refund policy which Mr. **** agreed to when he signed the contract final decision 3) the customers ******* boatyard, agents, contractors, and/or the boat sellers/buyers of the vessel will not or cannot perform the work required in order for the vessel to be transported.

      I am rejecting this response because:

       1). When I first contacted Mister *** Money / Mister **** Mover / ***************************, I told him he needed to contact both marinas to make sure that he could pick up and deliver the boat without a problem!

      2). **************** failed to do this, I called the pick up ******* ****** Light Marinain ************* a few times to see if he had contacted about the pick upthe office repeatedly said no, I would then reach out to **************** and ask him to please reach out and coordinate this.

      ***IF THIS HAD BEEN DONE AS **************** HAD ASSURED ME, HE WOULD HAVE BEEN INFORMED HE DOES NOT HAVE THE CORRECT TRAILER TO PICK UP THE SAILBOAT FROM THIS YARD!

      3). He repeatedly failed to make contact! If this was done in the beginning as promised to me by **************** he would have known immediately he couldnt do the job! And it would not have been at my fault or the fault of the marinas. and the deposit should have been delivered immediately.

      4). After chasing **************** fo most 5 weeks to refund our deposit he came up with multiple reasons why he couldnt do it rite away such as His Venmo account wont let him do the transaction the same with ***** the money had to clear!, he was on a cruise, its his birthday, and finally a bother him too much so he has decided not to refund our money at all!  

      5). all of this could have been avoided if he in good faith just refunded the money as he repeatedly promised us in texts (saved).  Please take note on November 20 th. After initially contacting **************** that day he contacted us 2 additional times within 2-1/2 hrs for payment.did we say he was harassing us, NO! We chase  him for our money back fir 5 weeks!!!!Yes we called many times, as any consumer would do when trying to get their money back.

           As you see by the 4 pages sent to me and signed,  Mister **** Movers Refund policy was NEVER SENT WITH THE CONTRACT as stated in the last paragraph of page 4 If he had a page 5 included in the contract that says the refund is non refundable clearly We would never have signed it.

      6). The Sailboat was never picked up because of his failure failed to properly contact the marinas at witch time he would have been informed he didnt have the necessary equipment to do the job as needed by the *******

      ( we have the 4 texts asking **************** if he could please contact the marinas to coordinate everything needed to do the job)

      As the Better Business bureau, your job as we see it,  is to protect the consumers from businesses that pray on the consumers money with shady and unethical business practices.   A business that does not preform the tasks agreed upon in a simple contract and is the fault of the business and then keeps the consumers money is unacceptable!.

      Mr **** keeps stating that i did not have the proper equipment/trailer which is a lie. We have a custom built 53Ft lowboy boat trailer that is fully Adjustable to any Hull. Our trailer can accommodate any boat up to 53ft in length and can has a carrying capacity of 40Klbs. his sailboat was only 38ft long and weighed approx 20klbs and he also claims that we did not contact the ****** to coordinate pickup which is also a lie. We had to call to setup appointment for pickup which we did but were told we had to speak with yard manager we left a message for him to call back which took him a while as he is a busy individual especially during the winter when he has to take out all the boats in the water and store them on land to winterize. When he called back he said any day was good to come just call when you are close. we started driving from ******* to *************. Before arrival we contacted the yard again to confirm everything at which time we were asked about the type of trailer we had when we told him the length of our trailer is when he stated that we would not fit in the yard due to all the winterized boats in the way saying that the travellift would not be able to reach us and we would not clear the turn he also said that he explained this to mr **** and told him specifically that he needed to send a hydraulic trailer so they would not need to use the travellift Mr **** called the companies recommend by the yard but they were booked out to far so he posted an ad on a boat group page we responded and he closed the deal with us at no time did he ask or did we say anything about a hydraulic trailer. Which makes it directly his fault that we couldn't get the boat  We spent time traveling wear and tear on our equipment money on fuel and tolls reserved a ****** vehicle and applied for permits all of these things cost us money and all of those items did not get refunded to us we lost our money. as you can see in the attachment, we attempted to refund his whole deposit but our bank did not allow the transaction to be completed from the business account we had to ach transfer the money which took a while and mr **** offered to pay a fee where is the money for the fee? anyways we reunded half of the money and my birthday came around and i left on a cruise during this time he was calling nonstop from early morning to late night sending text message and emails with threats trying to bully us around then he went on different social media sites, pages and group chats and bad mouthed us and talked smack about us causing us to lose money two customers that read his posts ended up canceling due to this. We kept some of his deposit to help offset the loss's of money we spent on fuel tolls ordering permits and reserving escorts and fees plus our time because we could have hauled another boat in that time slot and made money instead of losing and not to mention money lost due to his bad mothing on social media we stand firm on keeping part of his deposit for the expenses we endured and as he continues to post stuff online about our company we are preparing to file suit for defamation.  If a payment constitutes a deposit, then the general rule is that the deposit is non-refundable upon breach of contract. As such, if the buyer fails to perform the contract or pulls out of the purchase, the buyer has no right to the return of the deposit if the seller terminates for the buyers repudiatory conduct. This is because the deposit payment was made as security for performance. In summary, a deposit is security for the buyers performance of the contract. It is generally not refundable unless the contract expressly states otherwise. In contrast, a part-payment is refundable, subject to any losses that the innocent party may have as a result of the breach.

      I am rejecting this response because:

           I needed to have my sailboat moved from ************* to Long Island ********, I contacted *************************** and he assured me he could do the job with the equipment that he has, I asked him to please contact both ******s to make sure this could be done!!! It is very apparent that he has a trailer that can carry much larger boats but he does not have the necessary Type of trailer that ******************************* ********** *************, requires to get the boat out of the location that it is in And that type of trailer would need to be A hydraulic trailer If **************** would have just gotten all the information as I requested for him to do so I did not have to be a middleman in this matter, if he had contacted the people that he needed to complete this job at ****** like ****** He wouldve known within a few minutes of me signing his contract if he had The required boat moving equipment It sounds like **************** had a failure of communication with the ****** which is clearly not my fault.

             **************** at first sounded like he could handle all the communication and transportation issues with no problem, when it came up, he contacted me and told me he would return my deposit He returned $1000 of the $2000 deposit relatively quickly And then came up with excuses, it was his birthday, he was on a cruise, hes working right now and cant do it, ***** isnt working for him, he cant move the funds back-and-forth And so on and so on You get the picture!   Yes after about four or five weeks I had it! When he wanted my deposit, I sent it out to him that day, and a general reminder, he called me two times within two hours! Yes after three or four weeks I wanted my money back and I didnt wanna hear all the excuses any longer, this is no way for a legitimate business  to act. I think any reasonable person or company would think after three or four weeks of getting screwed around about a refund they too would be incredibly annoyed A refund can be done within a few minutes anywhere in the world!

      I have sense written **************** two times to say please lets put this behind us I will stop all legal proceedings, Retract my complaint with the Better Business Bureau, retract all social media and will not go forward with the *** and DOT.   I just want this behind us

       

      If this works for him, have him send me $750 back and well call it a day!
