      I ordered an attachment for a 314 CAT excavator from the company on July 11, 2023 and wired the company payment in full on July 13, 2023 as required by the company owner, ***********************. This attachment was ordered for a specific project starting on July 24, 2023 and I was promised delivery in writing and by verbal confirmation by **************. The unit was delivered over two weeks late and two weeks into a six week project that the unit was specifically purchased for which was made clear to ************** when I placed the order. When the order arrived, I opened the crate and immediately noticed that it would not fit the machine that I ordered it for. I called ************** and he admitted that he ordered it for the wrong machine. He suggested that I take it to a fabrication shop several hours away, on my time, to have it modified. After speaking with the owner of the fab shop, it was apparent that the unit would not be ready for at LEAST a week. At this point in time, I was already half through the project that I specifically purchased it for making the purchase no longer cost effective not to mention the inconvenience and time involved during a particularly tight construction schedule on a project being complete for the state of ************ and the issue of having a brand new attachment, costing $30,000.00 "modified". I told ************** this was not acceptable and he would arrange to have the unit picked up and refund my money. **************, during our last conversation, resorted to profanity and hung up on me. He now will not take my calls and has ignored emails ( I have written proof of all the above). I now have a $30,000.00 attachment that is completely worthless to me and there is no effort on ****************** end to make it right (and I quote "you have my work I will make this right").I only see two acceptable options: ************** arranges to have it picked up and refund my money or he replaces the unit with the correct one to fit my excavator.

      On July 11, 2022,  ************** contacted International Attachments via our online form.  On that same day, I sent ************** an offer of $30,00 for a PRO-50 Pulverizer.  There was a mix-up in pricing and I was charged $38,000 by the manufacturer, but I honored the quote at $30,000.  That same day, ************** verbally explained that he changed his mind and wanted a larger pulverizer PRO-150 for a CAT 314.  He originally asked for a pulverizer to fit a CAT 308.  Even though ************** ordered a larger pulverizer, we still honored the original pricing of $30,000.  ************** attached the purchase invoice, showing the order for the larger pulverizer PRO-150 for a CAT 314, to his Complaint.

      We received payment from ************** in the form of a wire transfer on July 13, 2023, in the amount of $30,000 and emailed him a hitch form to complete and return to us.  ************** did not complete the original hitch form with the measurements needed for the manufacturer to fabricate the correct hitch.  He texted me a picture of his *********** measurements, upon which I relied. (See attached printout of the picture of Mr.****** *********** notes received via text message).

      Due to the unpredictability of shipping, over which we have no control, we give our customers an approximate date of shipping and delivery, as there are so many variables that can delay and/or expedite shipping.  Also, our contract states the following regarding Delivery Delays: Buyer acknowledges that IAI has no control over the shipment and delivery of the equipment and that ***** is aware and acknowledges and agrees that IAI will have no liability for any delays in the shipment and delivery of the equipment . ************** reached out to me incessantly on weekends, evenings and holidays on my personal cell in regards to the timing of the delivery of his order, at which time we were in daily contact with our freight forwarder and relaying the information received from freight forwarder to **************  He was fully aware of any shipping delays that *** have been encountered.

      ************** called me upon receipt of the attachment and said that the spacing was off. Contrary to Mr. ****** assertion in the complaint, I never admitted that he ordered it for the wrong machine.That is patently false.  Because the attachment was delivered to ************** in ************, I was unable to verify whether the spacing was wrong at all.And if it was wrong, I was unable to verify whether the spacing was wrong because ************** provided the wrong measurements or the manufacturer made a mistake. Therefore, I asked ************** to take it to the fabricator, ****************** (******, **), so that the fabricator could verify if the manufacturer made an error on the measurements or not. If there was a spacing issue, then the fabricator could rectify the issue. From this history I assume that if there was actually a spacing issue with the hitch, it was due to the incorrect measurements that ************** provided to us. In trying to rectify the hitch issue and deliver high quality customer service, we recommended that ************* reach out to our fabricator as they are both in the *********************. ************** declined to do so.

      We made every accommodation for ************** and used every possible avenue to rectify issues. We are not responsible for shipping delays from third parties or incorrect measurements provided to us by the client. ************** still has the option of collaborating with our fabricator to complete the hitch for the pulverizer.

      My complaint has not been resolved and the proof provided by the vendor is fraudulent.  I never texted him that information.  The documented image provided  is not my handwriting.  It was stated a hitch form was emailed to me to complete, I do not have record of this email or form.

      ************** acknowledged above that he did not fill out the required hitch form. While the attachment previously provided is not fraudulent, it was an error to include it in this response to this complaint because although we believed it was from **************, it turns out it was not. Nonetheless, the company has offered the following resolution: *********** will coordinate pick up of the attachment and transport it to the fabricator in ************ for appropriate modification and then return to **************; the company will pay the transporter and fabricator directly.

      I am rejecting this response because:  I have not been contacted by the company regarding their proposed solution and I do not want the complaint to be closed until their proposed resolution has been implemented and I have the unit back in my possession with the appropriate modifications made so that it will fit my machine.  The option for "Accepting..." states that the case will be closed and documented as resolved.  This does not seem appropriate until the seller has done as he proposes. If the seller will do as he proposes and I have an attachment that will function and fit my machine, I will agree to close the case and state that it is resolved.

      I contacted *********************** (7/05/2022) from international attachments and was quoted a skid steer attachment. I secured a loan and he was paid upfront to assemble and ship to me. 2 months went by and after several complaints the attachment arrived. To our surprise it was shipped directly from *****. International Attachments claims all its products are assembled in *******. Upon inspecting the equipment I found it to be missing a critical component that would connect to our machine. (8/09/2022)I called ****** and he claims it was missing during shipping. After several weeks of emails ****** came up with several versions of why he couldn't send me the component. I explained to him I had tp get a loan and make payments on a piece of equipment I couldnt use as it was missing said component. (10/08/2022)****** said he would reimburse me $5000 so i could fabricate one. He failed to send the check. International Attachments uses fraudulent bussiness practices and deception. Had I known they don't assemble anything in ******* I would not have purchased from them.

      In response, equipment was delivered to ****************** and upon inspection, ****************** notified us that it was missing a bracket.  Since bracket had evidently been dislodged during shipping, we advised ****************** of same and in the process of trying to locate the missing bracket, advised customer that he can have one made locally and we would reimburse him, or we  could have one fabricated for him.  

      We were subsequently sent a bill for the bracket ****************** had fabricated and issued and mailed a check to him. The check was never received and when we were notified of this, we wired the money directly into customer's bank account.

      This issue has been resolved amicably between both parties.
