On February 27, 2019 I paid Caple Landscape Management $2,085.00 to install a Silver Bismark palm tree in the front of my home. The intent of planting such tree was to give privacy to a window. About 3 weeks ago, the same company which is the one taking care of the landscape in my community decided to cut all the fronds that were covering the window. This is private property and they have no right to arbitrarily decide how to cut it.Business response

Business Response /* (1000, 17, 2022/03/31) */ We did in fact install the palm, as stated. Our maintenance team performed the trimming of the Bismark palm correctly using a perfect 9 o'clock to 3 o'clock template - we did no damage to the palm and it is our charge as the provider for your community to maintain palms correctly. Consumer Response /* (3000, 19, 2022/03/31) */ (The consumer indicated he/she DID NOT accept the response from the business.) Caple Landscape Management's response is unacceptable. As stated in my initial complaint, I paid that company over $2,000.00 to install the Bismark Palm. The intent of installing that tree in front of a window at the front of the house was to create a privacy barrier for that room. Since I paid for the installation, it is my private property and it is only I who can decide how or when to cut it. The HOA in my community never raised a concern about the size of the tree, about the fronds or any other issue about the palm. I may have or may have not mentioned in my original complaint that: I went out as the workers were cutting the fronds and spoke to the person in charge. His comment at that moment to the one who actually cut the fronds was that he (the one in charge) had asked him (the one doing the work) to cut just the few fronds at the bottom and that he had overdone it. Clearly, from that interaction, one realizes that even the people doing the work knew that they had made a mistake. The only way by which Caple Landscape Management can fix this issue is to replace the Bismark tree and plant another one with fronds that will cover the window as it was originally installed. Destroying personal property without regard is one issue that not only goes against good business ethics, it is a criminal mischief in the State of Florida
