      I build a pool with swimming pools of Florida which included a deck. The contract says one year warranty from completion. They build the deck and it failed the inspection three times because some work was wrong and they needed to adjust it. The final inspection passed on 10/18/2021, and I contacted them on 10/17/2022 about an issue where some of the pavers fell off almost causing my son to break his leg. After speaking to them they told me warranty expired, even though they still have to fix stuff on the pavers before the inspection passed. I have been trying to talk to them but they never call back and they didnt even know that the deck needed an inspection.

      Readers, if your warranty expires for a product purchased at Brandsmart or at any other business, try returning the item for service, when they decline due to your contracting agreement, would you maliciously write lies as an attempt to slander the business name and character? 

      This is exactly what this individual is doing at very possible social media platform. The deck inspection he claims didnt passed 3 times is pie in the sky.  The inspector didnt like the word brick pavers on our plans and wanted the word brick removed from the plans and just leave pavers, yes, you are reading this correctly.  We have both plans to show to any interest party and comment from the inspector.  We made the plan revision and the city didnt charge us their usual fee due to the unreasonable request from the inspector.  

      Collective memory only favors one party, the subject complainer doesnt remember when his pool plans were approved by the city and ready to start construction, the customer canceled the contract due to his job and needed to be relocated.  After officially canceling his contract and time went by, he later called his representative and asked if he could please continue with the construction of his pool.  We opened his file, made all changes to keep going and did not penalize the client.  He was very happy through the entire process and final product.  

      Paver installation warranty under the terms of our contract is one year from the date the swimming pool deck is completed.  Over a year and 4 months later he aggressively called with a very bad attitude demanding, not asking, that his pavers needed be fix (2 pavers).  We kindly explained once again the terms of our contract, he couldnt understand why we wouldnt fix it at no cost to him.  He then called his representative November 7th upset, thats only one week from his negative posting on November 15th and not two or three weeks like he mentions on his complaint.  The representative did scheduled a crew to repair the clients concerns at a later date, but his generosity is now off the table.  This clearly represents his level of lies, unfounded claims, and poisonous intentions towards this company.

      I am rejecting this response because:The owner keeps calling me a liar and telling lies that I have proof that are lies. He never scheduled anything, he said he will give me a call in 2 days and I never heard of him. owner of this company continues to lie and call us liars. Yes they failed their inspection 3 times and not for the reason he is stating. The good thing is that it's very easy to know who is telling the truth. If you see the pictures below you can see that the inspections failed because they put additional pavers that were not in the plans and not because they needed to change the name from bricks to pavers. I know they put additional pavers, because I have the pavers they took out in my house, you can see them in the picture. I don't know how they can come in here and tell lies that are very easily proven wrong. Also, the first time I talked to them was October 17, and I sent pictures. Below is the proof that I sent the pictures on October 17. When I spoke with ****** on Nov 7, he said he will look at the photos and will get back to me in 2 days and he never did. So if you want to continue to lie, make sure those lies are not easily proven wrong.

      ****************** doesnt know our construction schedule, theres no need to lie, plans with correction of word brick to paver attached to this response.  Bottom line, the contractual agreement states the warranties provided to every client, please understand this part of your warranty is no longer valid.

      Faulty and sloppy work, unprofessional personnel (ownership) non-existent follow-up and follow through. Groundbreaking for the pool took place 01/06/2021. Final permit was pulled 10/2021. At this point in time, we have sinking decking due to insufficient and sloppy backfill and our pump system hasn't worked correctly since it was installed. We are now looking to fix the decking (marble tiles) for a 7th time since it keeps sinking in the same places (at the entrance of pool due to the stairs, around the spa and around the bench that goes from end to end in the deep part of the pool). The pump system and plumbing has now been "fixed" 5 times due to air leakages, pump water leakage, pump system improperly installed, forced plumbing and cracked plumbing. I would like to issue this complaint as the office avoids my calls and tells me things are going to be repaired and when they do come to repair they either break something else or repair it improperly so that the same issue keeps happening.
