Nelson Construction was engaged on Dec 2019 to renovate our 1636 Sq.Ft. Condominium to be completed April1, 2020. The job was not completed until late March of 2021. Greg N. stood in our living room belligerent, arrogant and condescending, waving his arms in the air pointing towards the family bath shouting that he was not bringing his crew back in to fix the very crooked grout lines on the wall tile so I could "sit on the toilet and see straight lines, I was too picky", and even though he admitted it was "me bad" for not letting us know that there could be an issue with chips in the tile cutouts, he was not bringing a crew in to redo something that could possibly happen again. I would like the work completed and corrected as promised.Business response

Business Response /* (1000, 10, 2021/08/04) */ Hello, We have made multiple attempts to resolve this issue with this client. Our GC, myself, and two different tile experts have been out to the site to investigate the matter. The issue is that the clients selected an exterior floor tile and asked us to install it on the shower walls. As mentioned to the clients on multiple occasions, we will be happy to install a different material if they will provide us with a tile made for wall application. But that will involve removing all the wall tile in the shower. This permit was closed out on July 28, 2020, per the official records. The city passed all inspections and the clients paid us in full for their project, indicating that they are satisfied with its completion. It is interesting that they did not have the courage to face us with these complaints, but instead waited until after we had delivered multiple warranty claims over the past year, including managing their condo for them while they were out of town and having a glass cooktop replaced for them, free of charge, when it was past the warranty period. At no time did Nelson Construction "offer" to correct the issues with the tile as described in the response. We were told we needed to complete a "change order" and assume financial responsibility for a complete remodel of the entire shower. Mr. N. assumed complete responsibility for the shower tile issue while standing within a few feet of us in the living room of our condo. He admitted that, upon realizing there could be an issue with the cut of the tile, Nelson Construction should have immediately contacted us to let us determine whether we wanted to proceed or choose another tile option. I quote Mr. N.: "me bad on me and my crew, for not letting you know". Nelson Construction should assume complete financial responsibility for resolution of this issue. I have spoken to two other contractors who have stated that yes, some tile is more difficult to work with, but not impossible, and the issue seems to be the level of experience with the person or person(s) who cut and installed the tile. Not addressed in the response by Nelson Construction is the very poor job completion on the grout border. As Mr. N. verbally indicated, again while we stood within a few feet of each other, "he was not bringing his crew to fix a job he considered perfect so I could sit on the toilet and see straight lines." At absolutely no time did we ever indicate we were happy with the job done on the tile throughout the condo. During the above indicated discussion, when I asked about the grout dust all over the floor and tile border, Mr. N. stated I should buy white vinegar, mix with water and scrub the floor. I would have thought this was something the contractor would take care of as part of the completion of the job, but apparently not. As you will note within the attached punch list, there were a few issues with the tile throughout, crooked and chipped backsplash tile, etc. There are multiple paint splashes on the tile floor throughout the condo, which we were told by Mr. N. during the same above-described conversation to use denatured alcohol to remove. Further, when we expressed dissatisfaction with Nelson Construction's site supervisor, Mr. N. defended him as being one of his best. But later in the conversation Mr. N. admitted that the site supervisor was a blacksmith by trade and had limited experience as a site supervisor. As to the statement of "Managing" our condo for a year, we are at a loss. What we will acknowledge is there were three deliveries, two from Macy's furniture (mattresses) and one from Best Buy Appliances (washer & dryer), which we, at the suggestion of Nelson Construction, coordinated with their work schedule and they accepted delivery on our behalf. We contacted building maintenance to secure the elevator for delivery, the delivery company phoned us when they were within 10 minutes of delivery, we then phoned the Nelson site manager who basically let them in the building. We paid for delivery and setup of each item. Nelson Construction assumed no cost and no responsibility for these deliveries. As to the cooktop, you will find in the punch list the scratch, as this was a warranty item at time of installation. Also installed was a microwave with a very noticeable dent, which also had to be warrantied. As for the courage to face them, as indicated above, we were within a few feet of Mr. N. in our living room during this conversation. It was during this conversation (more like confrontation) that Mr. N. started shouting and waving his arms to forget the last payment of $1,731.84, it was nothing to him, he was done and not correcting any issues. He had people that owed him $20-$30K more and ours was nothing. (Of the original $128,340 this amounted to only .01349 (1.349%) that was not paid long prior to this conversation. (Cost breakdown below). What has not been mentioned was that we were asked by Nelson Construction to buy the appliances that were part of the contract ourselves ($11,02.16) via a link provided, which we did. We assumed it was because of cash flow issues. Mr. N. shouted we did him no such favors, this was due to a "lost bank card," he has $500K sitting in his bank account right now. To my knowledge a bank card (domestic and international) can be overnighted via FEDEX. In some cases, the bank can provide one same day. We were also frustrated that it took so long to complete the "punch list" (items not completed or not completed correctly). Our joint walk through and identification of punch list items was completed September 16. The items were not completed by our requested date of end of November nor by our requested date of end of December. Hence, Nelson Construction's reference to "over the past year".
