    I am rejecting this response because: There are currently 2 expired open permits for the work I contracted with Quest Construction to perform. Both sit open as they still have not had a passing final inspection. Mr. ******* stated in his letter to you that just the final windows were incomplete, however the truth of the matter is much of the work on my home remains unfinished, from the windows all the way to the flashing of the roof that was not replaced. 

    On December 20, 2024 I paid for a professional Home Inspection to be performed and I can share the results of those if necessary. Since informing Mr. ******* I was done with his lack of completing the paid agreements, I have had a couple professional licensed roofing companies, professional licensed window companies, and licensed general contractors to come out and assess damages as well as what hasnt been done. All have stated that the windows and roof will fail inspection, remain incomplete, and are the cause of the water damage to the home. One contractor stated the windows used by Quest Construction would need to be entirely replaced due to them being too small, stating a large amount of filler wood would have to be used around them to make them fit. Another window contractor has stated the windows will not pass inspection due to the additional holes drilled into the frame that have compromised the window entirely.     

    The original interior trim is still present but due to the mismeasured windows Mr. ******* added many shims and filler pieces, rather than whole pieces of wood, and then covered them in caulk in an attempt to mask the big gaps. As of today, gaps are still allowing air to leak and water seep in, and with at least one window you can see sunlight coming through under the window. Along with the incomplete work, I have had many issues with the quality of work throughout the time Quest Construction worked on my home. For example, on December 23, 2023, the original 1930s kitchen window wooden valance (which is not even in contact with the window) was cut and in process of being yanked down. I immediately informed his worker, ******, that the original wooden valances were not to be removed. After I spoke with Mr. ******* about the damage to the valances and my unhappiness with the quality of work, he stated he would have a different worker moving forward. It is noted that none of these windows were completed with framing and sealing on the exterior prior to the damage. 

    The last 3 windows that took so long to install sat in my screened in room since May 12, 2024. 

    Six months later on November 16, 2024, Mr. ******* sent the same guy, ******* who did all the damage to the other 25+ windows, to remove one window that was cut into my stucco that was too big to install the smaller window. During that day the 3 last windows were installed. I was home, and Mr. ******* never showed up to inspect his employees work, despite knowing he was the worker who previously damaged my home. As the workers were leaving they stated they would be back 4 days later to seal in those 3 windows. I looked at their work after leaving and noticed they had opened my exterior wall wider than any previous windows and now my home has a large exposed area around those 3 windows. After not having any work done in months, the state they left my home in on November 16 left me very uneasy and I decided I could no longer accept this quality of work. 

    I met with Mr. ******* on November 19th, 2024 and told him I no longer wanted him working on my house and that I would like a refund. He tried to sell me the same lie he normally does, which is that he would get everything done ASAP and to please stay patient, but this time I was no longer accepting his excuses. Mr. ******* does a very good job at making you feel good about the situation while he simultaneously does not address the actual issues with construction. It was like a never ending cycle of excuses as to why my home remained incomplete, but I could no longer stay in this cycle. An example of one of his excuses was back in September 2024 Mr. ******* stated he could get this job (everything I paid him for by December 2023) completely wrapped up and done, but soon November approached and he still had not worked on my home. On November 19th 2024, the same day I met with Mr. ******* to cease all work, I also sent a certified letter stating I wanted a full refund of all the monies I had paid him.

    Mr. ******* received his letter and on December 8th 2024 we met again. Mr. ******* stated he wanted to work things out just as much as I had been asking for. If this had been true I highly doubt the work on my home would remain uncompleted after a year. I reiterated what was in the letter, that I was done. Mr. ******* re-stated what he texted me, that he knows he is in the wrong. Mr. ******* has acknowledged his work has caused more damages and even said he would pay to fix the damages. 

    As to the damages: The windows leak. The roof is leaking. I have interior damage and in one room there is now black mold growing. I have bubbling paint in one room under three windows due to moisture. There are cracks forming in the stucco from Quest Construction pressure washing the home but not sealing it. 
    I have gotten an estimate to repair all the damages and make things right to pass inspection as well as the contracts Quest Construction has been paid for. Mr. ******* received $51,342. One construction company has quoted me $109,000 to fix all damages and finish the jobs Mr. ******* started. I do also have another licensed and insured General Contractor coming the first week in January to give me a proposal and estimate which I will gladly share with you at that time.

    When Mr. ******* and I met on December 8th, 2024 I agreed to a lower amount of $51,000, the cost of the roofing contract, and then we could close this and move on. Mr. ******* stated he did not have that amount of money and we discussed a potential payment plan. I do not want to work with Mr. ******* on a payment plan, as I desperately need that money to fix my home and stop the damage from worsening due to weather exposure.  Mr. ******* has previously verbally offered to pay for damages and completion of work and I would like to accept that offer. The thing that I believe would show Mr. ********* utmost integrity would be him paying the secondary contractor to repair, and complete what I hired him to do. I will gladly accept an estimate from another licensed and insured general contractor to come in to give me an estimate that the BBB recommends. I am not looking for money here, I am simply looking to have the construction on my home finally complete after almost 2 years. 

    Looking to close this ordeal soon.

    I have entered into contract with **** ******** to change windows, removed a back stair, stucco patched 2 openings and replace the existing roofing.

    I have acquired a building permit and a roofing permit before commencement of work, this home is roughly 60 or more years old which comes with a lot of challenge however I have purchase new vinyl energy efficient windows which was approve with the building department and with current building codes.

    Upon working with the windows, the homeowner stated that she wanting new original trims installed instead of new modern trim which I agreed to accommodate her on 

    while installing the windows I noticed there was 3 windows which was not measure correctly before purchasing in which I took full responsibility of and reorder new windows which took some time to be delivered. 

    I am not negating that I took a while to finish the project, however I had sent my employee to complete the window on November 15th in which he had set the last windows but did not complete the work because of the weather, on Monday the 18th,Ms. ********* stated that she was done and she needs a refund of her money that she paid me. I stated to her to let me complete the work and she refused, she told me to have my employee pick up the rest of tools and she did not want to do many more work 

    I personally met with her on Saturday December 8th to try and work out a schedule or some form of agreement to complete the rest of work in a timely manner and she refused,

    I suggested to her that I would try and compromise to make her satisfied by getting three estimates to finish up the windows and I would pay for the repair she stated no and that the windows cannot be used again in which I could not comprehend because those windows was permitted and approve for her home.

    Then she stated that she would like to be refunded 32k of the contract of 52k that she had paid.

    I am willing to work out a solution to where Ms.Whimberly would be satisfied, and we both can part ways in a respectful way

    in regards to a his rejection letter yes I admit that the permits are expired because of the time that this project has incurred as to the roof, there is a flashing that needs to re placed after Ms. ********* sent the the information in a text I offered to **me and repair the flashing she said no , then she went a have another **ntractor came over and look at the work in which she was old me that the **ntractor stated ******* to repair the roof I told her I would pay for it and she refuse. I am really trying to **mpromise to have the hose issues resolved 

    as to the windows I offered to have her get 3 estimates to see which is less expensive to work with however she do not want I use the windows that was purchase for the home after she initially agreed that on the windows that was bought less that a year a ago , she stated that no e of the ** tractors wants to used the windows which I think is not **rrect because those windows  was purchased and apt by the building department as To shimming of the windows the house is 95 years old and original windows has no support be close enough to fit the windows perfectly so we had to build a frame.
    As to windows that are not totally finished at the time I send my employee there *** work for a day and was not finished **mpletely installing the 3 remaining windows the following day she turned us back and said she dont want anyone on her property to **mplete the work I went and spoke with her and ask her if i **uld just finished the 3 remaining windows and she said no , which I really think is undue her to send those photos to make her **mplaint. I also ask her to take take down the bad publicity that she is posting on social media about my **mpany And give me time to resolved this matter and she keeps posting all sort of negative **nnotations online 

    I really want o solve this issue and make her satisfied however all this bad publicity is not the right think to do , because I have not walk away or ignoring her **ncerns.

    Our last communication outside of BBB was on December 18th in which Mr. ******* said he doesnt approve of my comment on social media stating I would not recommend him. I responded and asked for his insurance information to which he still hasnt provided. I have not reviewed or posted about Mr. ******* nor Quest Construction since the response of him trying to work this out through the BBB. My only goal here is to get my home fixed, not tarnish someones business or name. I look forward to getting this all resolved and moving on.


    For the roof I informed Mr. ******* I received one estimate at $2,500. I would gladly accept the repairs and completions being done by separate companies if that is needed, but I would prefer just one company to oversee the job. One estimate I have for repairs and completion of all contracts is $109,543.50. He could even sign a contract directly with the new contractor and pay them directly. This would solve the issue. My goal is to get the work done and damages repaired as this has taken much longer than standard industry timeline.


    Mr. ******* also stated in his letter to BBB that he would pay for the windows after three estimates. I can send over two estimates I have received so far and can get a third estimate to send over so he can choose. None of the estimates I have received state we can re-use the windows Quest Construction put in due to the large amount of shimming that would be needed that would not be up to code. If Mr. ******* or the BBB have more companies in town they would recommend to use for estimates to see if the windows can be used, I would be happy to call them. I just do not want someone working on my home who has worked with Mr. ******* or Quest Construction in the past due to my concerns over the quality of the work. 


    As to the age of my home, Mr. ******* was well aware of the age of the home prior to accepting my first contract. He even informed me he had worked on many older homes previously. The amount of damage that has been caused by Quest Construction is evident and not refuted by Mr. ******* himself. 
    Again, I just want this all resolved and to come to an agreement. Please let me know how you would like to move forward.

    In order to rectify this issue Ms. ********* had agreed on a sum of 32k in which I am in agreement. However due to the posting of this issue on social media my company had lost a lot of business which resulted in financial difficulties coming up with this *** sum amount at this time , however I am willing to pay a her on a monthly basis or I would need at least four to 5 months to pay this in full.

    The contractor has failed to follow through and  repair the roof, on Friday 2/2/2024 I received a call from ************************ Stating that he was the son to the contractor and that his father ***********************. asked him to come and take a look at the roof, so I contacted ****************************** to meet with him at the church, he had one of techs to come to the church, ****************************** spoke with me afterwards and told me that the tech said that the roof wasn't done right and there are so many holds in the roof and he couldn't understand why it was done that way. The church has not received a response from the contractor nor the contractors son since Friday 2/2/2024. It has raining a lot and the new til that was replaced in the ceiling inside the sanctuary is wet from the rain, I took pictures today to upload and send along with this response, this has been a year long process trying to work with this contractor who took $96,000.00 of the church's money and did not fulfill his agreement according to his contact. On 1/31/2024 I requested documentation from the contractor stating what he had done to repair the roof and is this solution to fix the many issues, never received the information, and this is causing more issues because of the rain, mold and drywall, due to the neglect of this contractor.     On January 18th I have made contact with the church and spoke to Ms. *******  *********. And outlined a plan of action to resolve this matter on the 19th ********************** stating she could not met me at the church, however she had provided someone else to meet me there after arriving thee I now iced there were a few ceiling tiles was discolored for the water intrusion, mainly in the mens bathroom , and in one spot in the main sanctuary and another over in the sound booth.

    I made arrangements for me and the crew to come back  the next day which we did and spend an entire day at the church with 5 ************ fine tuning and make corrections where needed as of today we had repair the roof however I am waiting on a flashing to be delivered to my office and then it will be instaled estimated time of delivery will be on Monday February 5.

    In the meantime all the damage ceiling tiles has been replaced

    I am rejecting this response because: Quest Construction has not provided any documentation to what steps they are going to take to correct the issues, no documentation has been provided, and it's an ongoing problem with this company to provide proof of what they are doing, Quest Construction stated in their reply back to BBB that they spoke to ******************************, but we are requesting documentation, the church is not excepting word of mouth, the church needs documentation, the repairs for the roof was based on a contract not word of mouth, that is totally unacceptable, the church has been trying to get Quest Construction to fulfill their obligation to the contract that they submitted and they have failed to do so, the company forfeited their contract by not completing the roof in the time frame they stated on the contract and the materials that was purchased was not suitable for the roof to be repaired properly.  The contractor's negligence to repair the roof correctly from the beginning is why the church is in this position.  So, the church's position is for the refund of the $96,000.00 that was paid to the company according to the contract, and because of the roof not being repaired properly the church has occurred other issues which is a direct result of the negligence of this company.

    According to the Contractor Agreement Article 1. Scope of the Work it states that the contractor, would perform all of the work shown on the drawings and /or described in the Specifications, and to see outlined invoice as per scope of work, the Church never received any documentation regarding the scope of work that would be done and the contractor never removed any of the debris the church had its maintenance department remove the debris because it was a safety hazard. 2. of the contract states the contractor shall furnish a plan and scale drawing showing the shape, size dimensions and construction and equipment specifications for home improvements, a description of the work to be done and description of materials to be used and the equipment to be used or installed, and the agreed consideration for the work, the church never received any documents from the contractor with this information, and church is questioning the workers that Quest Construction used to repair the roof were experienced and knowledgeable roofers? 

    The Church is requesting that the Contractor provide this information in writing per the contract that the Church never received, what materials and the plan and scaled drawing showing the shape, size dimensions and the construction and equipment speciation's, as well as the requested documentation of what the contractor is doing to rectify these issues with a guarantee, word of mouth does not suffice in this matter as contractor gave the Church a contract for the work to be done and the Church wants this information in writing / and documented ,not word of mouth because for a year or more now the contractor has said many things but has not done anything he has said, the Church's position is to have the payment retuned in the amount of $96,000.00, because the Contractor forfeited the contract and neglected to do the work that the Church paid them to do and this has caused the Church many more issues.
