      On 3-Dec-2021, Advanced Paving Services (APS) installed a new asphalt driveway at my residence (cost $6,480). In late Mar-2022 I noticed a number of long cracks along one side of the new driveway. On 4-Apr-2022, I notified APS of the problem (see full timeline in Supporting Documents). At first ****, the owner of APS, seemed to accept accountability for the problem, and described the required remediation (undercutting to remove unstable subsoil/base layers, backfill with gravel, compact, and repave). However, over the course of several discussions and email exchanges, **** has shifted his position about the nature of the problem (water) and repairs (at my expense). My view is that APS was hired to install the driveway because of their expertise and long history of asphalt paving. If there were issues with unstable subsoil, improper grading, and/or water-management, these should have been identified in the initial assessment and estimation (the old driveway had similar issues). If unanticipated issues were identified during the installation, these should have been brought to my attention. The current proposal APS provided doesn’t address all the issues (see my response email in Supporting Documents). A follow-up email from **** describes the repair work in vague terms and states that any additional costs would be my responsibility. (I’ve already agreed to install a trench drain at my own cost.) The APS website states that the company’s reputation is built on honesty, integrity, and quality workmanship, but that’s not what I’ve experienced so far. I don't trust **** to give me a straight answer about the issues or what he is prepared to do to fix them (bait and switch). I’ve spent considerable time documenting the issues and researching possible remediation & costs online. I would like **** to either take ownership of this problem and deliver the quality workmanship his website promises, or give me back the money to hire someone who will do the job (no surprises).

      We have responded to customer and proposed the work below. See email sent on 6/2/22. 

      I will schedule a day to remove & replace the asphalt that we discussed & other concerns you have. Once we remove the asphalt, if the existing stone base is insufficient and it needs to be undercut & replaced with new stone, then there will be additional charges, because this is beyond our scope of work on the original signed estimate. The additional charges if any will be discussed with you before starting work.
