I hired Tim Luciano of Luciano Paving in December 2021 to repair and repave a small section of our driveway. Upon inspection he gave me a price of $2250 but said if I spent $5000 he would expand the area do a far superior job, I agreed and he said he'd be here in a few days, time was short the asphalt plant was closing any day but he'd get it done. This was a verbal agreement between us, he asked to be paid cash. Next day his guy came and prepped the area, the day after he came to pave. That morning one of the other guys I called for a quote showed up unannounced and quoted me $2200 for the same job. Now I realize Tim had about 3 hours time put in of site prep and his guys were on the way. I tried to ring him, no response. When his team showed up I asked his foreman to have him call me immediately. About an hour later he rang on his way with the asphalt material, I told him about the much lower quote from his competition, we agreed on a $500 reduction in price and he would complete the work and I was happy for some accommodation. All the time he said how shoddy everyone else work was and why he was so much better. I gave him the opportunity to settle up without finishing the paving but again could he live with the $500 adjustment and I wanted the higher quality result and him to do it, I told him wanted a better job even though I was spending >$1k more overall on his service. Well, the driveway has failed, it has a sinkhole/washout/pothole. I asked Tim to quote me for a sealing job and come to repair the failure. He wouldn't return calls, via text he said too bad, he wasn't interested in my sealing job or fixing his work and to call the cheaper guy, its not his problem. I paid him cash $4500 on December 20 2021, he provided no receipt. I have a text chain of us agreeing to the $5k and bank withdrawal record for the $4500. Again, I gave him the chance to not do the work, all I wanted was a bit of accommodation on price as I wanted his higher quality work.
