We purchased a new build from Lokal Homes and have had several issues since moving in, including a flooded living room due to an uncapped washer pipe within the first few days. Our most recent concern involved a water stain that appeared on the ceiling of our entrance hallway--given we had water-related issues in the past, we were worried.I contacted our warranty contact immediately via email to ***ort the stain and request an inspection. I received no acknowledgment or confirmation that someone would be sent. Without notice, a plumber arrived at our unit, and proceeded to cut a hole in our ceiling.I was forwarded emails after the fact between the plumbing company and our warranty guy that made it clear the plumber had requested the *** to notify us of the visit--the email read: "The plumber will be there between 2:00 and 2:30 p.m. today, please advise the homeowner". That notification never came. Additionally, the plumbers ***ort advised the warranty contact to follow up with the unit above ours, as the suspected source of the leak was from there.This happened on May 30th. It is now June 10th, and no one has followed up with me or confirmed that the upstairs unit has been inspected. Ive emailed our warranty contact multiple times and received no response regarding the status of our upstairs neighbor's possible leak/spill When I asked what would be done about the hole that was cut into our ceiling, I was told Lokal would not be responsible for any further action because the stain was determined to be caused by our upstairs neighbor. When I pointed out that the hole was cut by their plumbernot the neighborI received no meaningful response. The ***ly simply ***eated that water damage caused by your neighbor is not covered under warranty.According to Lokals warranty manual, something that's not covered by warranty is:Damage caused by anyone other than us.Yet in this case, their own contractor caused the damage, and they still refuse to address it.Business Response

Thank you for bringing this matter to our attention and our goal is to resolve the matter quickly. Lokal's ********* Warranty team has been in contact with the homeowner and they should have more information on the situation at this time. Lokal experienced challenges making contact with the neighboring unit's homeowner which is where the water leak is believed to have originated. This caused delays in action but Lokal has repairs scheduled for next week for drywall and paint items for this homeowner and is working with the community HOA to gain access to the neighboring unit to confirm the source of the water leak. Better lines of communication are in place moving forward and the homeowner should see a resolution and updates very quickly on this item.Initial Complaint

I purchased a condominium in January 2024 from Lokal Homes. It is the address listed for me. We were told by **** ******** that it had a wall-to-wall warranty for the first 12 months. He told us that separated between the backsplash and kitchen counter was to be expected and that it was covered by the warranty. ***** ********* was the construction manager and referred us to **** ******, was supposed to take care of any warranty requests. I emailed **** in May of 2023 because our faucet in our smaller bathroom was leaking, the backsplash had separated, and the caulking was peeling off of our master bathroom shower. I spoke to him and he said that they would fix everything but nothing was done. I put in a request for these three repairs on January 6 of this year with Lokal and received no response. I called them today and they are now telling me that the grout and caulking are not covered and they've ignored the faucet issue. At this point I would prefer a payment of $2,000.00 to cover the repairs since Lokal have not been reliable in fixing things promptly or properly.Business Response

Thank you for bringing this matter to our attention and we are eager to resolve this quickly. Lokal Homes has been in contact with the property owner and a Lokal Warranty Manager has been communicating with the owner about the matter. The previous Lokal employees mentioned in the complaint left the company mid 2024 and the homeowner's items were not escalated correctly per our company procedures so this is the most recent correspondence we have seen on the matter. Repairs for the shower and faucet items indicated in the complaint have been scheduled for mid February 2025 and the Warranty Manager will monitor these actions with the homeowner. We expect these repairs to resolve the matter and appreciate the homeowner's patience as again, the initial escalation was not properly communicated by the previous employees.Initial Complaint

LOKAL is a company that builds exclusively in Colorado and I in fact have purchased a new condo from LOKAL BUILDERS AND they have employed a LOKAL employee as an intermediate president of the Gateway Commons community HOA . For LOKAL to deni that I am a customer and to deni that LOKAL HOMEBUILDERS employee is acting president of the Gateway Commons Community is an outright lie. The mismanagement and deceitfulness runs deep. I will not withdraw my complaint.Business Response

I apologize for any issues this individual is facing in their situation. They have filed a complaint against a company that does not perform work in their Denver Market, I do to build homes not work under any HOA divisions in my local market. This individual is not a customer nor someone I have ever associated with. I believe this cosine was wrongfully filed under LoKal Construction LLC. Roofing repairs are not being done due to the HOA/run by builder and **** property management having insufficient insurance failing to file a claim (pushing homeowners to pay for repairs on their personal home owners insurance) for hail damage & falling into solvency ,roof defects have been identified, also I have issues with patio not draining properly and puddling next to wall ,fire door main entrance threshold isn't installed properly large gap at base of door, with numerous seams visible in drywall finishes, shower pan in master bath ************** when stepped on( suspected not installed properly) overall poor quality and workmanship not meeting standardsBusiness Response

We also would like to clarify a few items now in this complaint: After the May 30th 2024 extreme hail event where the community experienced 2.5 hail, Lokal engaged a 3rd party consultant and engineer who both determined the damage and water intrusion were the result of the hail storm that occurred that day. The *** formed an advisory committee of homeowners to seek additional professional 3rd party input for the benefit of the community. Through request of this committee, the architect of record (EV Studio) performed an evaluation and concurred with the report produced by the third party consultant that did not identify any variations from plans as contributing to any leaks from the hailstorm.
The roof referenced in the complaint was built to code specifications and inspected and signed off by the ************************** and there were no reports of roof issues or leaks prior to the May 30th hail event. Finally, the *** can offer more information on the increases to monthly dues and insurance coverage as insurance premiums have dramatically increased this year even without factoring in the May 30th hail event. Lokal has worked closely with the *** and homeowners this year to gain consensus on a repair plan for the roof and is continuing to do so at this time.

In February ******************************************** the *************** Community (************************) from Lokal Homes. Less than 6 months later I was faced with two major issues:1) the ********** controlled by Lokal Homes, is proposing to increase our monthly HOA fees from $215/month (as stated to me at closing) to $360/month as a result of insurance premium increases. The insurance premium was apparently negotiated in Nov 2023 and was not disclosed to me during closing, as such, mischaracterizing the cost of ownership to would-be homeowners. 2) On 5/30/24, a hail storm struck the area. During the storm, water poured into every 3rd floor unit of every building from the roof ******************** which were poorly engineered & installed, causing water damaged to every building. The Emblem Apartments across the street had no water intrusion into their units, just damage to the shingles, which is to be expected. Lokal Homes is actively preventing the ********* (which is comprised of 2 Lokal employees and 1 homeowner) to pursue builder defect actions and proposing that instead each owner is responsible for a $15,500 assessment.Business Response

On December 19, 2023, I closed on a new construction condo in the ************************* from Lokal Homes. The advertised *** **** were $215/mo. On 5/30/24, a hail storm struck the area. During the storm, water pured into every 3rd floor unit of every building from the roof ******************** which were poorly engineered & installed, causing water damaged to every building. The Emblem Apartments across the street had no water intrusion into their units, just damage to the shingles, which is to be expected. The Builder, Lokal Homes LLC, has majority control over the ********* until the project is 75% occupied. It is their contention that Lokal bears no responsibility for the roof **************** damage. We homeowners contend it is builder defect, but Lokal will not pursue a warranty claim with their roof subcontractor. Furthermore, Lokal Homes plans to reinstall the exact same room from the exact same roofing contract that performed the original installation, to the objection of the owners, and charge each owner $15,500 through an assessment.The reason they are charging the homeowners and not filing an insurance claim is because their roof design is uninsurable. Insurance companies refuse to lower their deductible for wind/hail damage (5% of the building value) to below the total replacement cost of the roof. This was not disclosed to homeowners prior to purchase, and Lokal is not willing to upgrade the roof with a design that could either be insured or withstand a hail storm, hoping they can finish the project before the next damaging storm occurs.Finally, Lokal is raising *** **** from $215 to $360 less than a year after the first units were delivered. I closed on my condo on February 29, 2024. The flooring was never level- it has been seven months for them to correct the issues- its supposed to be repaired at the end of September, but their lack of communication makes me wonder if it will happen. Also, in late May, we had a terrible hailstorm that damaged all of the roofs of all of the buildings. There has been water inclusion in the third floor units. They have done little to nothing to repair the problems. They have continuously lied to us about what their responsibilities are. They have used subpar construction materials and workmanship in building the units.Business Response

Lokal homes fails to acknowledge their responsibility for the roof construction defects. The architect, EVstudios, clearly called out galvanized pipe boots in their plans (or equivalent or better). The builder substituted out galvanized pipe boots with plastic ones that cracked in the storm and allowed water intrusion into the building and units. There were also ******* vents improperly installed in roof valleys that contributed to water intrusion. Regardless of the storm (which did NOT have 2.5" hail, we can provide photos from the scene), water would not have entered the units if the roof had been built to plans. *************** (the Lokal built condos), had 12x the percentage of units with water intrusion as the neighboring communities in the immediate vicinity. Lokal has communicated they are willing to settle to avoid litigation, but no proposal has been sent at the time of this posting. If Lokal does not put forth a substantial proposal that will cover all damages from their construction defects, homeowners will file a construction defect lawsuit against Lokal Homes.

Thank you for continuing the dialogue on this important matter as we at Lokal Homes want to ensure that we respond to all inquiries related to the roof that was damaged in the significant hail event of May ******* as well as any questions about the *** budget. As communicated earlier, the materials used in the roof construction met code requirements and were accepted by the Denver inspector as part of the construction process. After ongoing discussions with the *** board, Lokal recently made a very generous proposal to the *** board regarding the roof repair and that proposal is currently being reviewed by the *** board. Additionally, the *** board just approved a very practical 2025 budget that homeowners will vote on in a few weeks and your *** board can provide you information now on that item if you have questions. The 2025 budget addresses all required services for the community and does take into account the increase in required insurance premiums that just about all associations are currently experiencing. I am rejecting this response because: it does not address the points made in my first two comments.Lokal has still failed to address the fact that the homes were not built to the original plans. This has not been mentioned in the proposal either.
While Lokal states the city of ****** approved the buildings this does not hold any merit as all Denver construction defects were once approved by ******. The statement made does not guarantee there is no defect.
Please address all the points made in the previous two comments and address what Lokal is doing to ensure the buildings are built to the original plans.

On 02/29/2024, I closed on a new construction condo in the ************************* from Lokal Homes. The advertised *** **** were $215/mo. On 5/30/24, a hail storm struck the area. During the storm, water pured into every 3rd floor unit of every building from the roof ******************** which were poorly engineered & installed, causing water damaged to every building. The Emblem Apartments across the street had no water intrusion into their units, just damage to the shingles, which is to be expected. The Builder, Lokal Homes LLC, has majority control over the ********* until the project is 75% occupied. It is their contention that Lokal bears no responsibility for the roof **************** damage. We homeowners contend it is builder defect, but Lokal will not pursue a warranty claim with their roof subcontractor. Furthermore, Lokal Homes plans to reinstall the exact same room from the exact same roofing contract that performed the original installation, to the objection of the owners, and charge each owner $15,500 through an assessment.The reason they are charging the homeowners and not filing an insurance claim is because their roof design is uninsurable. Insurance companies refuse to lower their deductible for wind/hail damage (5% of the building value) to below the total replacement cost of the roof. This was not disclosed to homeowners prior to purchase, and Lokal is not willing to upgrade the roof with a design that could either be insured or withstand a hail storm, hoping they can finish the project before the next damaging storm occurs.Finally, Lokal is raising *** **** from $215 to $360 less than a year after the first units were delivered. We believe Lokal failed to properly budget the **** and as such, misrepresented the cost of ownership to would-be homeowners. We also would like to clarify a few items now in this complaint: After the May 30th 2024 extreme hail event where the community experienced 2.5 hail, Lokal engaged a 3rd party consultant and engineer who both determined the damage and water intrusion were the result of the hail storm that occurred that day. The *** formed an advisory committee of homeowners to seek additional professional 3rd party input for the benefit of the community. Through request of this committee, the architect of record (EV Studio) performed an evaluation and concurred with the report produced by the third party consultant that did not identify any variations from plans as contributing to any leaks from the hailstorm.
In the statement it references a neighboring building seeing no water intrusion from the hail storm, however two other neighboring properties did report to a 3rd party consultant significant roof damage and water leaking as a result of the May 30th hail storm. The roof referenced in the complaint was built to code specifications and inspected and signed off by the ************************** and there were no reports of roof issues or leaks prior to the May 30th hail event. Finally, the *** can offer more information on the increases to monthly dues as insurance premiums have dramatically increased this year even without factoring in the May 30th hail event. Lokal has worked closely with the *** and homeowners this year to gain consensus on a repair plan for the roof and is continuing to do so at this time.

I am rejecting this response because:No, such updates have been brought to my attention. They still have not given an update on the new budget other than they are going to try and increase it again. I have already had to hire an attorney one time to deal with other issues with my brand new home. They over poured cement into one of my floor drains. They spent months debating on who was going to pay and refused to pay for my hotel upfront until I hired an attorney (they had to rip out the furnace and turn of the water for a month) . This first issues was only for thousands of dollars, how are we going to get treated when the estimate is for 1.5 million dollars in roof repairs and why do they keep putting up the roofs with the same faulty materials. Need answers not blanket statements.
