      I was solicited by this company representative *************************** to assist me with my tax debt based on public information of a federal tax lien upon my property.Occurrence date May 2022 Reason for dispute/complaint is I do not feel I received the services that were promised to me. I paid $**** in advance and per the agreement I was to have a plan to present for my situation within 2 weeks. (the documentation they present states you can be refunded in this period)I did not receive a plan in 2 weeks. I got calls when the information had been retrieved, confirming everything I had submitted everything I had already done and due to the current state of my case.I waited for almost 6 months. Not anyone's fault, the only thing I didn't know was that there is a timer associated with this service that I wasn't aware of. No one told me that the waiting was going to cost me money. I feel as though this company solicited me and played on my emotional state (fear). They should have recognized that maybe I wasn't a good candidate for their help. Especially in that two week period. Since I was already taking action, Everything they say they could or would do I can do. I paid **** for a few phone calls and all I got was more in debt, added another year to my collectible period and another 12k to my outstanding tax liability. I have sent an email in April 2023 to the owner Trent ********************** asking for a refund but he wishes to talk on the phone. I would prefer corresponding rather then telephoning. I did make a second attempt to email that went unanswered in May. Today June 2, 2023 I called and left a message and received a return email asking when I can call. I don't want to talk to this man, he is an attorney. I am just a consumer. I am not looking to get into a combative discussion over what he thinks vs what I experienced. I just want to be refunded for services not provided. Thank you.

      When you hired us, you were in the middle of the Offer In Compromise process that you filed yourself.  After reviewing your financials, it was very clear that you would not qualify for an Offer because you have the ability to full pay, and the *** agreed as they sent a formal rejection of your Offer that you submitted, not us.  We worked with the *** on your behalf to have that Offer withdrawn as quickly as possible. We continued to follow up with the ***, requesting that your file be assigned to a revenue officer so that we could submit a new proposal on your behalf, during which, you were 100% protected from any collection action and we reviewed your financial information and had a proposal ready to be submitted.  In January, before your case was ever assigned to a Revenue, you requested for us to close your file.  As you stated, it isn't our fault, nor yours, that the *** took so long to assign your case.  Our hands were tied, but before you were eligible for a resolution, you asked us to close your file.  We did everything we told you we would do, within our power.  When you requested your file to be closed, we had put in over 27 hours of time, but regardless, I was still willing to give you a refund, but you were unwilling to take 5 minutes of your time to speak with me, so that I could verify that you were who you said you were, hear your side of the story and get you taken care of. (email attached).  But again, you refused to do so. We can't just send refunds to anyone requesting so in an email.  5 minutes of your time, and you would have been taken care of.  I am not an attorney, I am the President of the company and the only person with the authority to sign checks, a refund check in this case, and I was simply asking for 5 minutes of your time and in no way would that conversation have been "combative." I'm sorry that you you feel the way that you do and it's very important to me that all of our clients leave happy and am still happy to take the time to take care of you.

      I am rejecting this response because:  I am not satisfied that the proposed payment plan/arrangement was never completed.  I sent in everything I was asked to send in. I twice updated my financials and no one ever called me back to review my payment options for when it would be eligible to move forward.  The idea was mentioned many times but never happened.   I realized my case was pending movement with the **** What I didn't know was that time allotted is associated with the cost of your services.  So because of the time factor, I have to pay your firm more money to wait. Until I got called for money.

       It started with *****, then when she left the new associate assigned to my file contacted me for money.  I was very upset. You probably have the calls recorded to hear.  He was encouraging me to speak with someone about setting me up on a payment plan!  that was when I realized your firm is just ripping me off and because I refused to pay you more I told him that and that he can go ahead and close my file I would do this on my own.  This is the reason I don't want to call  anyone anymore.  I am lied to all the time. it's why I am in the situation I am in, people do not honor their promises. 

      If you cannot accept correspondence which I feel I have shared my experience with you. I don't know what else to do.  I just do not want to talk on the phone because I know it will upset me.  I am already upset having to write a dispute.  You have the recordings, and all the documentation.  I asked in an earlier response do I have to call you, you ignored me.  I did try to call, left my number and you never called me back..I'm not about the power trip here *****, I just want business like your to realize that soliciting people at random due to public record is an awful way to drum up business.  What is a phone call going to do?

      You didn't allow us the time to complete the payment arrangement as explained above, we have to wait for the *** to assign someone to your case after your Offer In Compromise, that you submitted prior to our representing you was denied.

      We do not record calls here, and again, our agreement would have been honored if you allowed the proper amount of time set forth by the *** to formalize the agreement.  You chose to have us stop working for you, which is 100% your right, but that doesn't take away the time we put in on working your case up to that point.  

      That's your opinion *******, which I respect, but again, that doesn't take away all the time that spent by our staff to keep you protected, continued communication with the ***, and keeping you updated on the status of your case for over 6 months.  I'm still happy to issue a partial refund.       I am rejecting this response because:
      The whole reason I am writing this complaint is because I did not receive what I was told I would.  I paid for a service you did not provide.  Do I need to share the phone records from all the calls I got from Suzie?  Do I need to do this much to prove my point?  Your company preys on people based on public information.  No one really listened to me. If they did a good business person would recognize that someone in my position at the time needed no help from you.  But you all insisted you could do things to help me. You did not help me at all.  Your company told me to withdraw my OIC appeal which I did.  Your representatives did nothing more for the duration except run a timer that took the remaining funds.  Then when the time was right you asked me to pay you more money on top of the **** that i already paid and received no modified payment arrangement proposal at all.  nothing.  I filled out forms, and sent you everything.  I do not have money to play these games  I just want my money back as I did not receive the service your representative assured me I would.

      Kutler called me because they were alerted to a notice of federal tax lien for back taxes that the *** was not including in my installment agreement. I had been struggling for 1.5 years to get through to an agent with the *** and was panicked about a lien as I could lose my job - when I was told that Kutler could get the lien dropped by updating the IA, I jumped to sign up even if $2.5k seemed high for a form and a few phone calls. Everything after has been downhill, past the sales pitch. I got notice the lien was filed anyway (before Kutler updated the IA) - turns out Kutler never spoke to the *** RO about the lien or explained the circumstances of the IA; they just plugged along and issued a IA without thought. So then I have to pay them another $1.5k to file a form appealing the lien and representing me. Absolutely zero was done on this front. The *** appeals officer confirmed nothing was ever received by Kutler, nor was anything done by Kutler to assist. I spoke with a local tax attorney in ****** who knows these *** officers who confirms this entire nightmare could have been resolved in the first two weeks had Kutler done their job and represented me instead of their pocketbook, and the reason I have a lien in place is because of their inept representation.

      ************ originally hired us to protect her from collection action, and negotiate an installment agreement on her behalf, which is outlined in her Service Agreement(attached).  We successfully negotiated an installment agreement on her behalf that she approved, and was never collected on by the *** by way of enforced collection action such as levy or garnishment.  ************ then asked us to submit a request to have her lien removed, which we did(proof attached) but before we were notified by the *** of the hearing date and time, she decided to cancel services with us.  In addition to completing every task on the service agreement, we successfully negotiated the removal of over $5,000 in penalties and associated interest on her behalf!(proof attached)  I am very proud of the work that **************** and her team did for *************  We understand the frustration that ************ had in regards to the time that the *** was taking to get back to us in regards to the lien removal request, but with the *** being so far behind still from covid, we have to be patient.  Because we stand behind our work here, and the satisfaction of our clients is very important, I still offered a refund for the monies paid to submit the lien removal request.  

      Though this was filled as a complaint, we see this as a record of some very good work done by **************** and her team here as we not only completed the service agreement work in full, but went above and beyond and negotiated the removal of over $5,000 in penalties.  Again, a refund was offered with no response to received.

      I am rejecting this response because the business is misrepresenting their actions to use this complaint as marketing.  Mr. Kutler offered to reach out to discuss, at which time he berated me that my experience was not possible and hung up on me. As seen in his response, he fails to acknowledge the *** did reach out for an appeal and his team had no idea. He fails to acknowledge the documentation submitted with the complaint that shows my prior attorney on record indicating his teams work was focused on the task of the installment agreement instead of the bigger picture in the very first line of the service agreement. 

      Mr. Kutler offered a refund of $1,500 only after this heated conversation. This response is misleading to insinuate that any full refund was offered, and no offer of a refund was made prior.  

      I do acknowledge and appreciate the work to eliminate penalities that was not in the service agreement. But it seems unreasonable to pay nearly the same amount back to this business as the fee for this service.

      I will accept a refund to end this unpleasant interaction.
