I have only had a few dealings with this auctioneer but the ones that I have had were very unpleasant. I have actually paid for multiple auctions with which shipping from the seller was included and I still have not received the items from the auctions, I have no information about what the status is and I am very hesitant to call them. I am hesitant because I did call once to try and resolve and issue and spoke to Skip, who was very rude and spoke to me like I was a child. Now here comes the real kicker, there was an auction that had lots actively open for bidding, I had bid on some of these lots and was winning the bids. The next day I logged in to check them and that was when I noticed they were just gone, I searched for about 2 hours. I finally called and spoke to Dani who then informed me that there was a decision made to take the lots down to split them into smaller lots. But it is my understanding that this is regulated and they have violated that regulation, see below. Colorado Statutes Title 4. UNIFORM COMMERCIAL CODE Article 2. Sales Part 3. Sale by auction SEE THE SECOND SENTENCE (3) Such a sale is with reserve unless the goods are in explicit terms put up without reserve. In an auction with reserve the auctioneer may withdraw the goods at any time until he announces completion of the sale. --->In an auction without reserve, after the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless no bid is made within a reasonable time. In either case, a bidder may retract his bid until the auctioneer's announcement of completion of the sale, but a bidder's retraction does not revive any previous bid. Cite as C.R.S. § 4-2-328 This is a dishonest behavior and the auctioneer who is required to have a license should know these things. Therefor they knowingly went against the code.
