I purchased a 2012 ***** Malibu from Akron Auto on 8/21/23 (24 days ago).I spoke with ***** about the car. He told me that he had sold this car before to a local, and it was taken great care of. I asked if the price could be dropped to $7,000 because KBB valued this car at $5,300. I thought it was a fair offer, ***** advised KBB is not right and a useless site to look at for pricing. I loved the car, and agreed to purchase it at $9,500!! $4,200 more than what KBB values it at for a dealer to sell, and $6,500 more than what it's trade in value is. I still decided that it was fine, this car has been greatly taken care of and this dealership has a shop - did all the right inspections, and was worth the premium price I paid them. As we were going through the paperwork, he showed me what they did, an oil change and replaced the tires. I noticed the AutoCheck Score was 37 and asked him concerned what it meant. He brushed it off and said he didn't know what it meant. This is his career, and didn't know what it was.17 days later on 9/7/23 anytime my wife would brake (with my 1 year OLD BABY) in the car, it would make a loud grinding noise. I took it to Brakes Plus, and they said all 4 brakes were SHOT, 1 being metal to metal. This means that Akron Auto had all tires off when they replaced them, looked at 4 shot brakes, and said "that is safe". My family was in a car that the brakes could have gone out at any time! I had Brakes Plus replace all of them, and then sent an email to Akron Auto asking if they could help me out since I paid such a premium cost. ***** called me the next morning, and said since I didn't call them there is nothing they can do. He said they could have changed them for 200 bucks, and that I should be upset with Brakes Plus! I went to Brakes Plus hoping it was something stuck in the brakes, found out my brakes were metal to metal, fixed them. ***** was making me feel like that was a stupid idea and asked why I like overpaying companies?

Akron Auto sold the 2012 ***** Malibu to *********************** and fully disclosed the accidents/damages. Please look at the attached AutoCheck history report and you will see his signature next to the autocheck score acknowledging all of the information contained within the report. ***** also signed three documents stating that the vehicle was sold As-Is with no Dealer Warranty, and no warranty for repairs after the sale. You will find his signatures on all three of these documents (buyers order, buyers guide, waiver of benefits) stating that he acknowledged that he was responsible for any repair that occurred after the sale. I have also attached several other 2012 ***** Malibu listings with the same trim level to compare the price to the one purchased. Akron Auto also discounted the price of this car $500 which can be seen on the top right of the buyers order. Akron Auto in not able to provide and further financial aid to this transaction.

I am rejecting this response because:

Yes I did sign all of this because I trusted ***** as a small town business owner and he advised me this car was sold locally and taken great care of by the previous owner.

Again, all 4 brakes were SHOT and it went metal to metal 24 days after buying this. When I reached out to him he advised they could have fixed it for like 200 bucks and I should be upset with Brakes Plus, and asked why I like over-paying for brakes! He was a trusting and nice person when I bought it, but the second I reach out for help 3 weeks after buying it, he was a completely different person. I sincerely thought Akron Auto was a business that cares about their customers.

      Regards,

*****, we find it appalling, you left our business expressing no concerns about the car you purchased. You signed several documents acknowledging that any repairs after the sale are your responsibility to address and pay for.You have an issue with a consumable item on your used car (pads and rotors) and never once called us prior to having the repair performed to even ask; my car is having issues, what can be done, or is there anything that you can do to help me. You made the decision to go to Brakes Plus and pay an absurd amount to replace the pads and rotors (front and rear) on that car. And you expect Akron Auto to pay your bill to another shop for something you never called about or authorized?Akron Auto will not provide any further financial aid to this transaction.

I am rejecting this response because:

Yes I am very aware you are appalled, as you made no effort to hide that feeling when I reached out to you on the phone 20 days after buying the car. My initial instinct was to stop driving the car immediately and get them fixed.  From what I understand brakes that are metal to metal are EXTREMELY dangerous and puts my family and other drivers at risk when drove. I have 3 children aged 5, 3 and 1 that ride in this car so their safety is my first priority. Akron Auto is 1.5 hours away and that thought didn't even cross my mind and even if it did I would have troubles figuring out how to tow it down there. I promise this is not a plot or master plan to have Akron Auto pay an outrageous bill.

I would disagree I left with no concerns.  I originally wanted to buy this car for $6,500, but ***** advised this car was sold locally prior to me purchasing it, and was well taken care of with no issues.  I wasn't happy but decided paying $9,500 was the premium for working with a trustworthy business who has it's own shop and wouldn't sell a dangerous car. After ***** collected the $9,500 from me, he then started going through all of the paperwork with me. I was in an excited mood until he showed me the AutoReport Score of 37, which had me concerned.  The money was already collected and majority of paperwork was signed at this point, so I wasn't even sure what to do at that point. I went with my gut that ***** was a trustworthy good guy and decided that report didn't mean anything. I know ***** could see my concern and attempted to lift the spirits with a free Akron Auto hat.

I paid everything I had that day for this car, and then had to pay over $1,000 for these brakes 20 days later.  I am asking to PLEASE PLEASE help me out with these brakes!

      Regards,
