      Tino was commissioned to put up a new 7 ft. fence on the north, east, and south sides of our property. We were also to have a double metal/wood gate installed on the north side and a single metal/wood gate on the south side. The crew showed up unannounced on Monday, November 15th 2021 at 7:30am, did not ring our doorbell, knock on our door, or attempt to make contact at all. They trespassed into our backyard and proceeded to cut down our eastern fence. It terrified my mother who was unaware of the strange men suddenly in our backyard as well as our eastern side neighbors. They tore everything down as I tried frantically to get ahold of Tino who wasn't even on-site yet. Tino's men tore everything down, killed two of our plants, cut down metal posts and left bases open, and jagged in the dirt without covering them up, and proceeded to secure new metal posts. Unbeknown to me, his men decided to recycle metal posts that were part of the previous fence and weld them together with the new posts. The fence doesn't line up with the property lines, it is well over 7ft tall in areas as they did NOT go down to hard dirt and is therefore out of Code with the city I live in. The lumber he used had mold/mildew and boards were broken, yet he still put it up. He left two-inch exposed screw ends towards my northern neighbor's side. He took down our current gate and said he wouldn't have the new one for another week and was going to leave everything open had I not told him to put something up. His crew then screwed our OLD gate into our brand new metal post on the northern side. The southern side new gate posts don't even line up and have a section of the old fencing screwed into the house just to keep our backyard "secure." I called Tino to voice my dissatisfaction the day his crew "finished" the job, he came by the next day, got upset when I tried to talk to him about what was wrong, he stormed off, and hasn't been back. He has tried to get money from me twice without fixing this.

      Tino’s Fence Inc. (TFI) and Mr. ******* dispute every essential fact set forth in Ms. ****’s complaint. Ms. **** had previously agreed to the date and time of the work to be performed, and when her neighbor harassed TFI’s employees on the agreed-on date of the install, **** assured Mr. ******* that the harassment would stop.  The job proceeded, and Ms. **** performed an inspection with Mr. *******.   TFI’s,  had originally bid the job for all-new posts. At the inspection, Ms. **** approved of the work, including her decision to use her existing posts to save money, the aesthetics of the fence posts, which included framing facing towards Ms. ****’s property. Thereafter, when request was made for payment by Ms. **** in order to complete the job, Ms. **** created a new story, namely, that she had never approved the job, that she had never approved to save money by using her existing posts, and that the job was unsatisfactory.  As proof  Ms. ****s timeline is incorrect, please see attached text message there was no problem with the work as indicated by Ms.****s until 2 weeks after the work was completed. Not until payment was requested that there was any problems indicated Ms. **** now refuses to make the necessary payments to complete the job. TFI has attempted to reach out to Ms. **** without result.

       I am rejecting this response because: in no way shape or form does any of what Tino stated in his response coincide with the actual timeline. We have provided ample proof and documentation that the work that was done is not what was agreed upon, was done unprofessionally and of poor quality, and was never completed. Tino has had ample time with which to correct this job and has failed to do so. The job was never completed, we are still missing our main gates. We do not want anything further to do with Tino or his fencing company. We have sought out legal representation at this time.
