On June 21, 2022, LSZ COMMUNICATIONS contracted with MELTWATER News. However, we found since then that Meltwater did not meet our marketing needs, the scope and relevance of the media database were simply not as advertised to us and as such, did not fulfill our campaign goals. We have advised Meltwater that we will be canceling the agreement but they are unwilling to end the contract. However, there is no cancellation clause in their contract.

I have been harassed by this company's salespeople for months. I had a sales call with one salesperson (*****************************) and we decided our companies were not a good match and my company would not be purchasing their services. I then got another few sales emails from someone else in the company, and I expressed my company was not interested in buying. Then I got more sales emails from another salesperson in the company. they will not leave me alone after telling them to leave me alone, that we weren't interested, and that I wanted them to delete my email out of their database. they now just called me from a private number trying to sell to me again. They will not leave me alone. it is harassment and predatory practices.

I had previously entered a complaint with BBB about Meltwater about 2 years ago indicating that they harassed me with multiple repeat phone calls after I asked them repeatedly to remove me from their list and not call again. I just received another call from Meltwater in which the caller again expressed zero acknowledgement for my wishes to not speak, be called, etc. ************ is aggressive to the point of harassment and I do not wish to receive any more calls from them which they clearly will not honor.

Meltwater says we missed our window for cancellation (however I am not the name on the account but should be) and says we cannot cancel our subscription for this year and MUST pay for their service for another calendar year -- even though we haven't used their program in years and will not be using it for this year either. They have sent the last signed agreement for service from 2018 with membership expiring in 2019. We have no recent contractfor the last two years (2020 or 2021). We have been grandfatheredin and the price has risen over time annually - again no acknowledgment of it doing so within the 2018 agreement signed by someone that no longer works with our school. The person who signed that contract has not been with us for three years. At no point, in that 2018-2019 contract does it state a cancellation or refund policy. They are holding us to an imaginary adjudication. If we are out of policy for requesting cancellation to a service that we do not even use currently - then we have also not been provided with a change to policy within our agreement for the last four years. The customer service and account management for their product has been sub-par over the years and is one of the main two reasons (aside from inactive use) that we no longer desire continuingon withMeltwater. After MULTIPLE emails telling them since March that we do not wish to continue and we will not be paying - they continue to harass us by sending invoices for payment. We are a non-profit educational institution. We will not be bullied or harassed to pay for something we are not using after months of sending emails acknowledging that we no longer wish to continue.

We terminated our contract via email with our Meltwater representative, *********************************, on May 12, 2021. Meltwater ********************************* not only received our notice to terminate but replied at least twice trying to persuade us to change our minds on termination. She was unsuccessful. Our written termination occurred well in advance of the 60-day notice required under the agreement, and therefore, our agreement and any financial responsibility to pay Meltwater ended October 1, 2021. Our Deputy Director, ***********************, followed up with an email to Meltwater confirming the earlier termination on September 8, 2021 (53 days before the end of the subscription). Another Meltwater representative, ***********************, contacted us saying that our email termination on May 12, 2021, does "not constitute as a written cancellation". He is incorrect. Neither Meltwater's agreement nor Terms and Conditions specify the type of written notice required to terminate. Notice to terminate contracts via email is widely recognized and accepted by courts as legally acceptable. Another Meltwater employee, *************************, claimed that she "didn't have a termination notice in their file" for us when all each Meltwater representative responded to our email notices to terminate. Meltwater refuses to recognize our legal terminations and has sent us a $12,800 invoice and claims that we now have a late charge on top of that. We tried to negotiate a good faith settlement with their general counsel, Nofa Khadurri, along with other members of their staff to no avail. As you can see from Meltwater's BBB rating of D- and many similar complaints/reviews, this behavior is unfortunately the way they do business.
