April 22, 2022:MG Estates was hired by contract to sell items from our deceased fathers home in an estate sale. This was a 2 bedroom, 2 bathroom home. The home was fully furnished, contained antiques and collectibles as well as had a lot of engineering and construction equipment on the property. The pre-value estimation of all items came in roughly at $20,000. The final check to my sisters and I upon payout from MG Estates was $5900. ******* (owner) stated that he received only $10k in proceeds in which we do not believe 1:) ******* refused to provide a sales sheet/log of items sold 2:) as ******* and his staff were preparing the sale (one month in advance) there were several items missing from the property prior to the sale. 1. Commercial size power washer 2. Art/Pictures 3. ***** and antiques. As I watched these items disappear I asked ******* to itemize items sold so that we could be able to track the sale of items. ******* became very angry and refused to itemize items. He then willfully cancelled our contract. He states that I did so however in writing I have that he cancelled the contract and then charged my sisters and I $1900 for contract cancellation. My sister took over the relationship stating that we indeed did need to move forward with the estate sale, in looking to trust ******* she paid the $1900 and moved forward. Thus again, there were not any itemized lists of items sold and the small amount of a $5900 check from ******* is what we received for all items sold. MG Estates has been a rip off and ******* has shown to be nothing but a common thief. I will also move forward and denounce this company and take to court if necessary. We are asking for payment back to us for at least $4000 to cover what we believe MG Estate has stolen.Business response

This complaint has been filed by our original client for this job. After requesting, then demanding that my company set high reserves on dozens of items *********************************** cancelled the estate sale during a phone conversation because we would not allow her to set exaggerated prices on any estate items. This occurred on March 30, 2022, two days before the estate sale, and after all items were already priced. She had previously signed our contract giving my company the rights to determine all pricing for the sale.
Within a week of the cancellation, her sister and co-administrator shamefully apologized for her sister's actions and offered to pay all cancellation costs with the hope that my company would continue with the sale. After all cancellation costs were received my company agreed to move forward with a under a new contract, signed by the complainant's sister and co-administrator.
We have had numerous cancellations over the years but this was the first time my company received a cancellation payment from a client. We usually send a few invoices out and then we assume it will never be paid. This cancellation was paid within a week which led us to believe that our client and her family had taken responsibility for the stop of the sale. Also, the complainant stated in this complaint that her family was unhappy with the results, but upon receiving this complaint I phoned my final client and she assured me she was satisfied with the results, and again apologized for her sister's continued actions.
We never make estimates or financial promises to our clients, and that's due to the unique nature of each estate and always changing market conditions. And especially since the start of the pandemic the sale of second-hand goods has become very challenging. Where the $20,000 amount unknown and actual final proceeds (100%) were at $9,851.00. Client expenses totaled $970.15, for advertising and garbage & debris removal from the 1.5 acre property. All remaining client proceeds were given to our final client, and no other funds are available or allocated for release.
The included itemized list of all items selling for $100 or more was provided to our final client as requested.
Also included with this reply are both contracts, final invoices and administrator paperwork.
BBB, please put a stop to this complaint. It is absolutely slanderous and any further action by the complainant will only cause more unnecessary problems, and court cost for both parties involved.
