      The ********* of ********* of Trailing **************************** aka BHE Management decided not to enforce several CC&R's which include parking with very limited guest parking and not enforcing parking 2 cars in each homeowner's garage to save money. ********* of ********* has a duty to enforce the CC&Rs whether it is zero persons complaining or even one person complaining, they are committing a breach of fiduciary duty and must enforce the plain letter of the CC&Rs that have been in place over ***************************************************************************************** writing. Desired settlement: enforce all CC&Rs and 3 months worth of association dues: $537.00

      We received a letter for termite inspection requirement. On the very same day I received the letter I called the termite company and scheduled an appointment for Monday, November 14 at 12:30 p.m.. *********** was a no call, no show. I called the termite company and they did not return my call.Fast forward 7 months later, I received a fee on my HOA account, without notice, $50 for noncompliance of a Termite Inspection. I paid the check and figured I would dispute it later as to not have our association fees be behind. I wrote on the check, which was cashed on July 7 that "We made appointment termite company was no call no show". On July 19, I received a letter dated on July 7, the same date the check was cashed for the mischarge fee of $50 I received a letter stating an additional $100 fee would be charged. They could not even give the ***** of a week before the second mischarge was added to my account along with a hearing date.I called BHE management, left a message on Thursday, July 20, no return call. I called the termite company on Friday, July 21 and spoke to ****** and *** who confirmed that we had an appointment on Monday, November 14 at 12:30p.m. *** took responsbility for the company's mistake and told me he would reach out to BHE management to remove the fines and that I should not have paid the $50 and that should have been removed as well since I did in fact have an appointment. We scheduled an inspection the very next day Tuesday, July 25 at 8:30 a.m. and this time they completed the inspection successfully. I logged into my account and the $100 fine was not removed. I am seeking assistance to remedy this matter and to request a meeting with BHE management and association to discuss de-escalation and proper investigation prior to home owners being charged in this improper manner.

      ***** of ********* Trailing **************************** DBA BHE Management "We our not allowed to contact any vendor directly unless it is a property threatening emergency".Great ***** ********************* (Vendor) damaged a downspout while trimming our community trees. Replace with new downspout. They did not clean up cut branches after trimming the tree. We our not allowed to contact any vendor directly unless it is a property threatening emergency. They refuse to provide a business email for the board of directors. They want us to wait until the next open board meeting which is at least 1-2 months away which includes 72 parking violations and cars parked in fire lanes which we use to be able to call into the patrol company directly. The landscape work vehicles continue to park in the fire lanes.

      BOARD OF DIRECTORS TRAILING VINE MAINTENANCE ASSOCIATION aka BHE Management Corp. I am requesting a refund for two months of *** fees because the *** prevented me from reporting CC&R's violations and below standard landscaping maintenance when the requirement is a well maintained landscape for a two month period. These CC&R's have been in place for over 17 years. The cease and desist order was sent on May 18th and the next board meeting is July 14th (2 months). There was never any indication from the *** that I was sending excessive emails until the cease and desist order. The intent of the emails was to provide evidence of CC&R violations and shortcomings of the landscape and tree trimming services. Some of these violations have been going on for multiple years. There were excessive violations and landscape issues. They never quantified how many emails are excessive which should be applied to every homeowner (CC&R) after multiple requests. They never provided a list of vendors which some of them we use for our own home. The board of directors should have an email available to homeowners so they have the ability to report any potential wrongdoing. i.e. ************************ Also the board should require that they approve any cease and desist order after listening to both sides of the story. Total for two month *** fees: $358.00

      To the ***** of *********************************** DBA BHE Management Corporation Reasons for replacing current ***:One of our neighbors just moved in next door with 6 adults and 6 cars. They park 5 of the 6 cars in the very limited guest parking. Besides the CC&R requiring them to park 2 cars in the garage; the *** said there is no CC&R restricting the number of each household parking their cars in the guest parking. So they are allowed to park all their extra cars in the guest parking area. The *** does not currently enforce the 2 cars per garage CC&R even providing images. I also informed them there are multiple households in the community that are doing the same. This creates an already oversaturated guest parking situation. Im pretty sure when they wrote the CC&Rs they assumed that there would be 2 cars in each garage and the guest parking restriction was not needed. I asked ***************************** and the manager of BHE if they could do something about this, but they refused. No offer to create a new CC&R with board members approval. So they must enforce the 2 cars/garage which they have not done. They will only enforce it they happen to see a violation with their own eyes during their once a month inspection. They want to charge more money with their next contract if it is more frequent than that. The previous Trailing Vine Manager (****** who still works for BHE) used to have announced periodic inspections of the garages. My next door neighbor has been parking only 1 of 2 cars for over 15 years in their garage!I received a cease and desist letter from the *** attorney demanding that I cease contact with any of their venders, and stop sending excessive emails to correct multiple code violations and landscapes issues that are below standard maintenance threshold in the community. The attorney said it was against the law to do this. In actuality the vendor reached out to me after leaving a negative anonymous review in Yelp. Please see attachment for rest.

      The *********************** have never sent out any surveys about the services they provide. Over the 16 years the services they have been providing has declined. Parking is the biggest problem in the community. Very limited guest parking. *************** is no longer proactively monitoring the problem. They are relying on the residents to report the problem. We are paying association fees to pay for this. Many residents are parking only one vehicle in a two car garage which is required per the CC&****************: *************** will only allow the ******************* trim certain types of plants/trees on a scheduled basis and not as needed basis which results in unsightly landscape. The purpose of the association is to provide well maintained landscaping which also includes oxidized paint on lights and signs in the community that need repainting which also needs to be on a as needed basis.72 hours parking in guest areas: The current patrol community does not proactively monitor this. They rely on the residents to report this. Many people work and cannot monitor whether or not a particular car has been parked in the same spot for 72 hours. Once it is reported the patrol company won't issue a citation until another 72 hours.
