      Hello,My name is *****************************. I recently lived at ********************** Which is managed by Chico Sierra Properties. Upon moving in, I realized the carpets had not been vacuumed only shampooed. I have video proof with dates that I moved in and vacuumed and found many things including metal within the carpet. So, I asked ***** to finish the job since we had already started paying rent. I moved all of my belongings into the kitchen and gave them a week to fix the issue. Nothing was done, and this is only the beginning of the obstructive behavior ***** displayed. Since moving out, I provided a forwarding address and never received an itemized list or receipt of why my entire deposit is being kept. My mom filed a security dispute form request. Since then, we have been mailed a cease and desist to the forwarding address stating we have accused her of racism. Yet we haven't received an itemized list of why our whole deposit is being taken from us. I'm reaching out to the BBB to help me get my security deposit returned. I left the house with only normal wear and tear and at this point she has personalized it and is trying to bully my co- signer and me. We have both been nothing but respectful and received nothing but the opposite. Every concern I have tried to address has been met with personal remarks regarding my personal life in a negative manor. She has never cared for the tenants and continued to do so throughout the year. She offered my roommate a renewal who was late on rent three times but refused to offer me a renewal for only reasons she knows. Which then I accused her of discrimination because she could not give me a valid reason as to why I was not being offered a renewal. I have contact with the previous tenants and they stated they were charged for the replacement of flooring. Upon moving in there was no new flooring. Per an email ***** emailed to the co- signer, she is now withholding my whole deposit for new flooring as well.

      Again, this e mail is coming from ****************** who the BBB recently denied from filing a claim for not being our tenant.

      #1. The Cease and Desist letter mentioned in the claim was mailed to ******************, not her son.

       

      #2.  This e mail ( Appfolio tracks sent e mails) was sent to *******, spelling out every detail of the deposit and where it was returned, and what we needed.  It is showing that he opened that e mail prior to this claim being filed.  Since it was opened, and this e mail contained the information that this complaint is stating to BBB that  he did not receive, AGAIN, my assumption is that this is again coming from *******************   The only other option is that it would be coming from ******* who we can then show is himself lying to try to defame our business.  Which at this point has become just too many times.

      I am again asking the BBB to deny this complaint.  If the BBB needs a copy of the email that was sent,delivered and opened by ****************** to show that he or his Mother are purposefully lying to the BBB, I would be happy to.  Please just reach out.

      If ***************************** has questions on his deposit, I would suggest reading over the e mail again, sending me forwarding information and as with any tenant, if he has  questions on what was charged, he can refer to his move in with pictures, his move out with pictures, all of the invoices and if there is something that we have charged that should not have been charged it will be reversed.  As of today, ******* has not reached out to me 1 time with any questions regarding his deposit.  Just a refresher on information that ******* would have in his portal, which tells me this complaint is not from him.

      May 10, 23-  ******* was given the option of new carpets with a larger deposit, or keeping the old carpets.  He choose (in writing) to keep the old carpets.                                                                                                                                                                  July 19, 23- Carpet Restoration cleaned the carpets when the old tenants moved out.   No animal smell noted                                                                                                                                                                                                                                          August 3,23- Carpet Restoration given the keys to go back in and re-clean as tenants did not feel it was clean enough.                                                                                                                                                                                                                          At *******'s move out, the carpets were saturated with urine, attempted to clean the carpets, but unable to get the urine out.  All flooring in the unit had to be replaced at over $4000.  Of which ******* was charge ZERO.  Only charged for the cleaning which did not work.

      Again, this is all spelled out in the email that we can prove was sent and opened prior to this claim being filed, so this is coming from ****************** or from ******* (which would then be false info given to BBB).  At some point this needs to stop and I am not really sure other than a lawsuit what it is going to take to make them understand that.

      Please remove this claim and if ANY documents are needed to show what I am saying is the 100% truth do not hesitate to ask.

      I am rejecting this response because:  ***** did not return my security deposit or any itemized statement listing the amounts withheld within the 21 days, as required by law to the forwarding address I emailed to them 7/11/23 9:28am. ***** missed the deadline and forfeits the right to deduct anything by law. Yes, I did reference the cease and desist letter the property management wrote to my co-signer and find it very un-professionial that letter made it to my forwarding address, but not whats required by law or any other documentation  to justify withholding my entire security deposit. We filed a security dispute form and got more un-professionalism from owner or accused of harassment, as we have experienced the duration of the lease. 
           They have kept my money in bad faith and I ask for your help to collect it. In addition I have contact with the previous renters, who stated this property management kept their entire deposit too un-warranted. Seems like a trend and after sharing my experience with other customers and classmates, many have experienced the same conditions and I feel I needed to escalate it and they need to be investigated. BBB denied by moms complaint because of third party accusations, despite me being a senior and her my co-signer and signed a contract with ***** too. I ask BBB to help get me security deposit returned, as they didnt meet the deadline and forfeit that right! Shes treated me like a child and it's like talking to a wall when dealing with any level of problem with **************. I've been nothing but respectful, but she's been mad at me since move in for questioning the dirtyness of the ocndiiton of move in. The owner talks herself up about how shes been in business for almost thirty years and should of known better she needed to forward this to the provided forwarding address, as required by law.

      Everything we do is in writing. Every text every email and ****************** can see just as easily as I can. It is spilled out in two places in the least that when a person moves out of the unit, they either have to be present at the move-in or they have to leave their forwarding address on the kitchen counteri. In April, we sent another refresher email to the tenant on how to prepare for a move out, reminding them that if they were not going to be present to leave the move out address on the counter.  When the email was sent to us prior to your move out, ***************** was told immediately in writing that that person could not accept it and he needed to leave it on the counter when he moved out. Again, all of this is in writing so we are able to prove. At move out no address was given so by law we have to send it to the last known address which is **************************, which is exactly what we did.  
      It is very simple. Me Carerra has been given the itemizations ge has been given the receipts he has been given a move-in sheet with pictures. He has been given a move out sheet with pictures. If there is some thing that he feels as though hes been charged for that he should not have been charged for he can certainly contact our office. My guess, however, is, thats not the case. All of these items were justified.  What hes simply trying to do at this point is badmouth our office, which youve been doing from day one, threaten us, call us racist, and the list goes on.  We deal in facts.  You simply either did the damage and get charged or you didnt do the damage. You have everything in your possession to simply show us where we have overcharged you.  I have everything in my possession to show us that no forwarding address was given, and we mailed it back as the law requires us to do.  A mother calling in yet again to tell us where to send some thing after the fact is not something we are going to do. This mother does not seem to understand the fact that she is not part of the lease and we are not going to send documents to her simply because she requested them. The cease-and-desist letter was to ******************. Not her son.

      At this point in time, I simply cant keep reiterating the fact that these individuals have everything in their power to show where we have done something wrong. Continuing to simply state, incorrect fax over and over and over is simply strengthening my case against defaming our business. *** noticed at this point how everything that ****** said that *** been able to disprove has simply been taken out of their narrative at this point and new accusations put in. It needs to end. I will say it one last time if ****************** has any issues with what hes been charged, simply show us where we have charged incorrect items and by all means they will be reimbursed. Hundreds and hundreds of pictures are attached for him to view.

      I am rejecting this response because she did not even respond to my last allegation that she forfeited the right to withhold any of my security deposit for not mailing an itemized statement of the alleged damage I did to the unit within the 21 day deadline which is required by law. I returned the house in normal wear and tear condition and completely disagree with what Ms. ***** is saying. She has violated my rights as a tenant and forfeited the right to keep any of my security deposit and should be responsible for damages up to two times the security deposit for illegally holding my security deposit but all I am asking from the BBB is that my original amount that was paid be returned. I do not know why she is bringing up this defamation against her business but I believe she is doing so to deter from my original dispute. It has felt like talking to a wall when communicating with Ms. ****** She has bullied myself and my mom (co- signer) and treated us like garbage from the beginning. I do not understand how she is still in business with this kind of treatment towards tenants. I disagree and am responding to her last comment. I disagree with every charge she had made up, except for maybe one or two screens that were not put on. I have live videos of my move out, the videos will show the house was returned in the same, if not better condition it was given. At this point if she keeps going back to her point of defamation to try and deter us from continuing. I would ask the BBB send an investigator to go look at her books and talk to previous tenants that have not only faced the same problems as me but have also shared the same experiences that I expressed.

      They deducted from my checking account the full rent for June of $725.00. The rent is prorated since the lease ends on June 9th 2021. The overcharge of $508.00, when contacted I was advised their system does not allow refunds. I spoke with their employee Kathy who was extremely rude and even after advising her I am the co-signer on the lease and it is my account that the money was deducted from since my daughter is a college student at Chico State and she is my dependant and I have been paying the rent and the security deposit. I have also requested the refund by email with no response. The college students also have a $3400.00 security deposit with this company and have a reputation of not returning any of the deposit, I also have requested our deposit back as well which is $840.00. Thank you for your assistance in this matter.

      The tenants set up automatic payments with Appfolio on their portal to pay their rent.  We do not have access to their account number or any of their information.  All payment amounts that are pulled must be authorized by the individual.

      Since HE paid the incorrect amount we told him what options  we were able to provide, 1 being that they could call their bank and have the payment reversed.

      He did just that, weeks ago.  I was told at that time by him that he had called BBB and reversed these complaints, as well as other reviews that he wrote on us with this incorrect information.  Obviously that did not happen.

      We even went so far as paying the $40 Stop payment charge that Appfolio  charges when a payment is reversed.  A fee that should have been charged to the person that made the incorrect payment.

      Upsetting that we took care of this immediately, but weeks later nothing has been done to rectify that the information on these complaints are wrong..

       

      Please let me know if you need me to provide a copy of the ledger sheet showing the payment reversed as well as the charge to reverse it.  I am also happy to provide any documentation from Appfolio to show that ALL payments are set up and authorize by the individual only.  We, nor Appfolio has any power to change and deduct any payment that was not set up directly with the indivdual.
