I, ********: ******, trustee of ******************************************, file this complaint on behalf of ******** ******, the beneficiary of the trust, against *********************************. (LCI) for their erroneous & fraudulent reporting of a Maryland bankruptcy case (USBK COURT MARYLAND# *******), which has been wrongfully associated with ******** CARTERs personal credit records. This false information was sold to **********, causing significant financial & reputational harm to the trust and its beneficiary. ******** ****** has previously filed an *** ** Theft Report, which includes the fraudulent Maryland bankruptcy item. ****, 15 U.S.C. 1681c-2 says, once a consumer provides an identity theft report, the furnisher of the fraudulent information & the *********************** are legally obligated to block and remove the fraudulent information in 4 days from consumers credit file. Despite this legal requirement, the erroneous bankruptcy item has not been removed from ******** CARTERs credit report.LCI erroneously matched a MD bankruptcy case to ******** CARTERs personal identity. This false information was then reported to **********, resulting in an inaccurate bankruptcy entry on her credit report. ******** ****** has never filed for bankruptcy, and this error continues to harm her financial standing LCI failed to comply with Rule 9037 of the Federal Rules of Bankruptcy Procedure, which mandates the protection of personal information in bankruptcy filings. Their actions have violated ******** CARTERs privacy rights, & my fiduciary duty as trustee to protect her from such harm. Despite ******** CARTERs timely filing of an FTC ** Theft Report, which specifically lists the fraudulent bankruptcy entry, LCI and ********** have not fulfilled their legal obligation under the **** to remove and block the inaccurate information. This is a direct violation of 15 U.S.C. 1681c-2, which mandates that such information must be removed immediately upon receipt of the ** theft report.

I am filing a complaint against ********** and LCI, Inc., now known as ** **** ***********, for their inaccurate reporting of a bankruptcy on my credit report. On June 17th, 2022, I filed for bankruptcy under Case Number ************* However, this bankruptcy was voluntarily dismissed on October 18th, 2022, due to misguided legal advice. Despite the dismissal and the fact that the bankruptcy court sealed the case, ** **** *********** has continued to verify and report this information to **********, resulting in its inaccurate presence on my credit report.

I contacted ** **** ***********, and they informed me that they have no fax number, email, or mailing address to receive disputes or requests. They also claimed that they do not verify information, yet continue to report this inaccurate data to **********. This lack of transparency and refusal to provide proper contact information is alarming and raises serious questions about the legitimacy of their verification process. Furthermore, ** **** *********** is owned by **********, which suggests a conflict of interest and a breach of my data privacy rights under the Fair Credit Reporting Act (FCRA).
