      Hello, I put my house up for sale a few month back and I received and accepted the offer from **** ****** (Agent for Miramar International INC) **** is representing ***** ******. Part of our contract was for the buyer to put down earnest/deposit money in the amount of 2000 dollars so I can take if off the market. House was taken off the mark 4/7/2021 and we set to close with 30 days but did not. Buyer than asked for an extension which was given to him with a condition for the buyer to release 1000 dollars from the deposit money to me the (seller) which Escrow released 1500 to extend the day to June 18th. Turns our there was some issues with the buyers loan and ended up not closing the deal on or before June 18th. Because of this I am now owed the full deposit for lose of time and house being on the market potentially losing offers furthermore, during this time I still had a mortgage to pay.

      Hi *******, ******** accepted to move forward with the $1500 deposit.. ********'s and his representative were well aware of the deposit amount they received. They had a right to cancel or send out a notice to perform regarding a deposit dispute. At this point we have a signed cancelation from ********e that relieves both parties from any relationship and obligation. ********e contractually has reached a resolution. In regards to ******** having to pay his mortgage during the transaction, well that is his responsibility. There is nothing in the contract that says the prospective buyer has to pay for his mortgage payment. ********e has received the full $1500 deposit. Jaqueline, there is no more money in escrow for him to collect. ********e has received a total of $1,500 and he wants more. Unfortunately, the buyer and the lender could not perform. There is no guarantee ever that a home will sell. What can I do? ********e and his Realtor have the cancelation. Please have him read it and send you a copy.
