    I recently bought a new construction home and have been the only resident since January and still have no neighbors. The community's *** is managed by Elite Housing Management, which no one within my community has oversite on. They have driven by my home MULTIPLE times and are trying to enforce fines for items that are one beyond my control (sod was laid in Jan and isn't growing great) and have provided proof from my lawn care service that this isn't something that can be "fixed" in their 10-day timeframe. They also state that I have received a notice of non-compliance for my fence that was recently installed (yes, I did install it without *** permission because that was the guidance I was given from the selling agent since I was the only person in the neighborhood). They have assessed me a fine of 100$ for something they never gave me written notification about but stating in the notice that they have which I have documented proof there isn't. I have spoken with other people in communities managed by this company, and they aren't even following the outlined rules in the *** covenant. I have lived in this house 4 months and have been harassed by an *** that has no oversite within my own community.

    Elite is the third-party management company chosen by the Declarant to assist with the everyday operations of the HOA. While the community is still under construction it will be under Declarant control. Once every home has been built and sold the community will be turned over to the community to form the homeowner Board of Directors. One of the operational factors of HOA management is the enforcement of the covenants and bylaws, which were provided to you upon closing. This includes Elite conducting 2 compliance inspections monthly to document any covenant violation with a timestamped photo. 

    We understand that grass seed may take some time to grow in and see results. It is not our goal to impose fines rather enforce the covenants. We ask that the resident keep us informed of their on-going plan to remedy the violation, so we can notate the account accordingly. If additional time is needed you may email the steps you are taking to correct as well as a rough estimated time of completion, once received we will review for consideration on an extension. 

    All Architectural requests must be submitted and approved in writing as outlined Article III Section 3 b) “No exterior construction, addition erection, or alteration shall be made unless and until plans and specifications showing at least the nature, kind, shape, height, materials, and location shall have been submitting in writing to and approved by the Architectural Control Committee…” Unfortunately, the sales agent verbal approval will not suffice as outlined in the covenant above.

    Article III Section 3 (c) viii. outlines what fencing will be approved in your specific community. However, Article III Section 3 b) also states “The Architectural Control Committee shall be the sole arbiter of such plans and may withhold approval for any reason, including purely aesthetic considerations, and it shall be entitled to stop any construction in violation of these restrictions.” 

    Each HOA community has its own set of covenants recorded, which results in the varying restrictions and enforcement you may see in other HOA communities Elite manages. When Elite issues a letter, it is sent 3 ways to ensure the homeowner receives the notices. Elite will share a copy of the document on the online portal, mail a copy to the mailing address on file, and email a copy to the homeowner via the AppFolio emailing system. This email system lets Elite see if the emails sent have been viewed by the homeowner. 

    As the management company, we do not have the authority to remove fines once they have been assessed to the account, especially if the violation is still active. Once the violations have been corrected, you then may email your thorough dispute to [email protected] and explain why you feel your violations did not constitute a charge, please provide any supporting documents to assist. Once received it will be reviewed for consideration on violation fine removal. Please note that Elite nor the Declarant profit from any violation charged to a homeowner. Violation fines are not intended to be a profit source for the HOA, they are in place to ensure incentive for compliance of the restrictive covenants that are agreed to when the homes are purchased.

    We moved at our home almost 8 years ago. Six months after we moved in, we contacted the Neighborhood HOA on what needs to be done to install a basketball goal. We were instructed to cement the post in the ground. So, when we purchased the basketball goal, we paid for that type of installation. It was cheaper to place it on a stand but we wanted to comply so we paid the special installation. We received no complaints for 7 1/2 years. Now, we get this new HOA manager and we receive a violation letter on 21 Feb 2025 stating that if we dont comply in removing our basketball goal, we will be fined. Then, they claimed they sent a courtesy letter on 8 Jan 2025 but we never received it. We contacted other neighbors with basketball goals and they never received any notifications at all. How can we be in violation when we got the boards approval over 7 years ago. We believe that we are being singled out and discriminated because its a basketball goal. We are not planning to remove the basketball goal. If we need to make this public and have the local news to cover this harassment, so be it.

    We are a management company hired to carry out business operations for the *** and on behalf of the ***.
    Part of our operations and functions include covenant enforcement. We are not the ***, and we do not make the decision on what is enforced or not enforced. We send letters to homeowners who are not in compliance with their community's covenants as written and/or per board directive. The letter received stated that there was no architectural approval on file for the basketball goal and asked to provide written approval or submit an ARC request through the online portal. It was not stated that the basketball goal had to be removed. The courtesy was emailed to the email address we have on file on 1/16 and the status of that email in our system shows it was opened. It was also shared to the homeowner portal the same day. There has been no communication from the homeowner to get clarification of what is needed. There are several properties in the community with the same violation as we are enforcing the ******************* wide. We were directed to get a copy of prior approval if the homeowner has it available. if not, then we will just need an application submitted via the homeowner portal so we can send it to the ARC for review. Again, removal of the basketball goal has not been requested at this point. We would like to thank you for reaching out and we encourage you to call our office for further resolve and clarification.

    As previously stated, you have not been asked to remove your basketball goal. It was requested that for anyone that has one installed to please send in your previous approval so it can be added to your account. If you do not have a previous approval, or proof of it, please submit a request through your homeowner portal so we can submit it to the *** in your community. Once approved, it will be added to your account and you will not be asked to submit for it again. Elite was hired by the elected board members of your community to enforce the covenants and follow directive given. We cannot control or change the directive given by previous elected members to previous management companies. We are simply doing the job we are hired to do.  One of our functions is covenant compliance. As stated in Article VI section 36 of your covenants "All basketball goals within the community shall be of a glass or acrylic material, and may not be permanently placed without  prior approval from the ******************************** Wooden or Fiberglass basketball goals shall not be allowed" Please also see Article VI section 10 for the Architectural Standards.     I am rejecting this response because: approval was granted over 7 years ago. You were recently hired this year. Instead of sending threatening email, you should have asked the home owners first and provided forms initially instead of assuming we didnt get approval. Besides, send notices to all home owners which are applicable with permanent stance, which I did contacted some that never received a notice from Elite. ******* *** directors admitted that they didnt get all prior approvals from the previous property managers and to be patient until they sort this out.  How did you show patience by sending that type of email.

     You need to be professional and respectful because home owners are paying your salary anyways.

    *** is wanting homeowners to pay more for their homeowners dues to cover the other homeowners that don't want to pay their homeowner dues.HoA also wants a 20% increase to homeowner dues to cover landscaping costs. Even though there has been completely no landscaping done, except for mowing around the retention ponds. What are they doing with the money? When they're getting $300 per house, between 85 homes that are in the neighborhood.

    Elite Housing Management is a Vendor hired by the *** to manage the daily operations of the **** Elite pays the bills for the **** we do not collect extra money outside of our set management fees. Elite advises upon request what it will take to cover basic *** ***** and the decision to increase or not is the responsibility of the Board of Directors. The Board of Directors are residents of your community whom volunteer their time and efforts to make the best decisions possible for the betterment of your **** Unfortunately, the delinquencies within the community will cause a ripple effect and put the *** in a financial bind, causing the need to raise dues. The delinquent accounts are referred to an attorney, which will do their part to collect on behalf of the **** The increase in landscaping costs are not due to extra landscaping. It is due to an increase in bid price for basic service that is effected by inflation just like everything else in today's times. Bid requests are sent out and a decision is made by the Board of Directors as to which company to select based on pricing and scope of work covered.  We appreciate your concern and certainly understand your frustration. However, this complaint is misdirected as Elite is simply the Management Company. If you would like to be involved in the decisions made for your **** it is encouraged that you put your name on the ballot at your next election.     Persistent harassment from this company managing HOA for my neighborhood and insisting on charging absurd fees for noncompliance with edging and a dead tree. In an emergency medicine physician working night shifts. I have edged my lawn/yard and it is now fall and it would make no sense to replace a dead tree as the replacement would only die yet again, and therefore informed them that I will replace the tree in Spring.Yet I get no response and they continue to send me mail charging me increasing fees. First fee was $30, now I have an additional $60 fee. This makes up more than 10% of the annual HOA fee. I continue to be harassed by this company and threatened to be charged more fees. It is making me feel uncomfortable living in this neighborhood and uncomfortable residing in my own home. Im a first time homeowner and this experience is making me regret the whole process and is dissuading me from purchasing another home in the future.

When a violation goes uncorrected, we must impose a fine based on the fine schedule adopted by the specific ***s decision makers such as the Board of Directors and/or Declarant. When a violation is noticed by our driver, a courtesy notice is sent out first notating the specific covenant violated as well as their timeline to correct and Elites contact information to discuss. If it goes uncorrected, another letter is sent warning of the impending fine. If the violation is further ignored, a fine is then imposed. The process continues through the entire fine schedule until the violation is corrected. Once the violation is corrected, our notices will stop and additional fees will not be added. Elite does not financially benefit from the collected fines. Those monies go directly to the ******** account. The fine process is not designed to accumulate money for the ***, it is in place to attempt to incentivize homeowners to comply with the *** rules they acknowledged when they purchase their property. Owning a home in a covenant restricted community is intended to keep everyones property value at its utmost for the benefit of every homeowner. It is a covenant entered in to upon the voluntary purchase and holding a deed within.  A management company is in place to uphold the agreed upon Covenants and Restrictions.     April 8, 2024 I reached out to Elite Housing to ask questions regarding my property and documents. I requested the owners name or the person in charge. They refused to provide it. Shortly after calling I received an email stating my account had been disabled. Elite Housing is committing adverse actions against an innocent party, ***************************, who is the equitable and rightful owner of ************************************************************************, in the ********************** community. *************************** has been a victim of identity theft, mortgage fraud, title fraud, securities fraud, and insurance fraud and has ************************ and Madison County Sheriffs Report as evidence. I received an email stating that my account had been deactivated after contacting their office and I requested that the account be reactivated or I will be forced to take legal actions against EHM. With the help of a private investigator and a Bloomberg Auditor it has been revealed that my Parcel ID # and legal description are involved with fraudulent activity tied to two other property addresses within the ********************** community. The other addresses are *********** and 119 Edgestone. Also it appears as if Elite Housing Management is actually JIT Services. JIT services and Elite housing Management need to be audited immediately.

    Elite Housing Management provides HOA management services for ********************** Homeowners Association.  On January 31, 2023 Elite was provided a copy of a Foreclosure deed for the property at ********************  The deed shows that due to an unpaid debt the property was sold to Alavest LLC.  Upon receipt of the deed, with a stamp showing it was filed with the ***************************** on 1/11/2023, Elite Housing Management moved ********************** to past homeowner status and entered the new Owner as Alavest LLC.  It is standard procedure to make this change and to also deactivate the past homeowners online portal with our system.  When ********************** called the office on April 8th it was discovered that when Elite changed ownership of the property in our system, that ************************ homeowner portal was mistakenly left active.  Therefore on April 8th her portal was correctly deactivated.  If it is deemed by the courts that her property was sold under fraudulent activity, then upon receipt of that information, Elite will reinstate her as the owner of ******************* in our system and reactivate her online homeowner portal. As far as Elite Housing also being JIT Services, we are not in any way affiliated with JIT Services. JIT Services owned the building we used to rent our office from.

    This company is a bunch of scam artists. They refuse to hand over the *** to the community and sight people for things that no one sees as an issue. Their management is terrible. Everyone who works there is rude, including the president who i've actually spoken to. Anybody looking to hire an *** management company needs to stay far away from this place. The solution I'm looking for is hand over the *** to the people at magnolia place in ****************** and ***************** in *********, *******.

    Elite Housing Management (EHM) has been under contract with the ***************** *** since 2019.  During this time, EHM has provided continuous operational support to the Declarant *****.  Like all communities that EHM manages, the directives concerning the day-to-day operations come solely from the ***** of **************** At no time or under any circumstance does EHM make decisions without consultation with the *****. This consultation applies to the ***s finances, care and maintenance of the communitys common areas and individual owner compliance.

    Regarding the ***s turnover to the owners, the transition process began on 7/27/23 with the request for nominees interested in volunteering for the new ***** of **************** Nominations were received and voting ballots were sent to 61 owners.  Unfortunately, there was not much interest amongst the owners as only 15 ballots were returned which did not meet the minimum required.  For this reason, the Declarant ***** requested EHM extend the voting period an additional 30 days in an effort to obtain the minimum number of votes needed so the new owner ***** could be seated and the transfer of the *** can be completed.

    I am being fined by the *** roughly every 20 days for my fence. When the covenant says every 30 days is the length between fines. I have not had the proper time to remedy the situation and I am just being harrased aggressively at this point.

    Elite Housing Management (EHM) oversees the day-to-day operations of your Association. EHM provides needed support to the *** and takes all directives from the ***** of ********** We realize at times that owners may not agree with how various situations are handled, specifically situations concerning compliance and individual owners. But EHM does their best to enforce the Covenants and Restrictions as they are written and per the directive of the *** ***** of ********** 
    Note that the primary objective of your Association is to uphold and improve home values by maintaining standards that create cohesiveness and consistency within your community. 
    As per the covenants for ***************** regarding Architectural Standards, Article VI Section 10: No exterior construction, alteration, addition, or erection of any nature whatsoever shall be commenced or placed upon any part of the Community, except such as is installed by the Declarant, or as is approved in accordance with this Section, or as is otherwise expressly permitted herein. No exterior construction, addition erection, or alteration of any nature whatsoever shall be made unless and until plans and specifications showing at least the nature, kind, shape, height, materials, and location shall have been submitted in writing to and approved by *******************************(s) established by the Declarant. The following items, without limitation, must be submitted to the ******************************* for written approval, fences, basketballs goals, posts and hoops, detached buildings, detached garages and any other exterior items on the premises. The Declarant may employ for the ******************************* architects, engineers, or other Persons necessary to enable the Committee to perform its review. The ******************************* may, from time to time, delegate any of its rights or responsibilities hereunder to one (1) or more duly licensed architects or other qualified persons, which shall have full authority to act on behalf of the committee for all matters delegated and in the event of such delegation, the applicant shall be required to pay any fees charged by such architects or other qualified persons.

    As per the covenants, when our compliance team took pictures in May 2023, and a Courtesy notice was sent 5/26/2023 by email informing you that: we noticed the unapproved fence (please submit an ARC request through the online portal) 
    On 7/17/2023 an Impending Fine written notice was sent by email and post mail, since no written approval or ARC (Architectural Review) form had been filed, stating: we noticed your unapproved fence (please submit an ARC request through the online portal). This notice gave 30 days to rectify: Please resolve this violation within 30 days from the date of this notice, or a fine in the amount of $30.00 will be assessed to your account upon the next scheduled inspection. 
    On 9/06/2023 a Second Written notice with fine was emailed and post mailed, since there had been no resolution to the previous letters regarding the unauthorized fence. This letter stated: unapproved fence (please submit an ARC request through the online portal) remains unresolved. At this time a $30.00 fine is being assessed to your account due to non-compliance. An additional fine in the amount of $60.00 may be assessed if this violation remains unresolved following each inspection period. 
    As per this letter: an additional fine may be assessed if this violation remains unresolved following each inspection. The ******************************* the First Impending Notice prior to fines being charged. After that letter all fines can be assessed following each inspection. 
    On 09/28/2023 a Third Violation notice with fine was emailed and post mailed, since the concern had continued without resolution. As per the previous letter: An additional fine in the amount of $60.00 may be assessed if this violation remains unresolved following each inspection period. An additional fine in the amount of $90.00 will be assessed if this violation remains unresolved following each inspection period. 
    On 10/17/2023 a Forth Violation notice with fine was emailed and post mailed, since the concern had continued without resolution: At this time an additional $90.00 fine is being assessed to your account due to non-compliance. An additional fine in the amount of $120.00 will be assessed if this violation remains unresolved following each inspection period. 
    On 10/24/2023 an Application for Architectural Approval was filed by yourself and has been approved. 

    If you would like to email for fine forgiveness, now that the fence has been approved and the Violation corrected, please email that request to ********************* and we will forward that to the Community ***** for review and directive. 

    Please note that there are several notations on the account where calls and emails had been received that foul language and belligerence was used. We are here to assist the boards and the homeowners a like but will not conduct business in such manner.

    I was cited for weeds in the yard. I had several issues dealing with and getting a straight answer out of the management office. They ignored me and now I am being served another violation notice after I responded with multiple other community issues that are not handled regularly. I believe the management company is targeting me for informing them of their shortcomings.

    Elite is a HOA Management Company that is hired to handle the day to day operations of an HOA. We perform a service for a set monthly fee that is billed to the HOA each month. We do not take money from any individual homeowners account. When a homeowner pays HOA dues, they go straight to the HOA bank account. Each homeowner is aware that they are purchasing a home in a covenant restricted community, and are given a copy of the restrictions at closing. They are also available on our website www.ehmusa.com. We are not at liberty to discuss other community member's violations with their neighbors. Therefore, we cannot make Mr. **** privy to the information regarding who has been sited for what within the community. When the builder has turned the community over, we will be able to give the elected board members access to the compliance reports for the community. The complaints that Mr. **** has are invalid due to the fact that multiple other community members have been and will continue to be cited for not being compliant with the community standards. He is not being targeted, we just cannot disclose the other residents that have been cited for the same non compliance issues as he has. Please see the below response from the Compliance Department on this matter.

    I am rejecting this response because: I speak with my neighbors and they are not getting notices from EHM. I also have photos of the multiple violations that occur all day everyday in the community and I have watched your drivers drive right past them and pay them no mind. I would appreciate EHM actually investigating my issue instead of saying it is invalid.

    I am rejecting this response because: Elite housing management is garbage and will do nothing to treat all covenants equally in relation to enforcement. They consistently and continually mismanage the community. I look for**** to they day they go out of business or allow the people in the community to run the community. They should be ashamed and embarrassed by the fact that they take money from homeowners annually and provide the absolute minimum management.
