Description

I am filing this complaint regarding deceptive and misleading refund practices by EverVision. I purchased EverVision after relying on their prominently advertised “Better vision or it’s free” 90-day money-back guarantee, which appears on their product sales page and states that customers may return the product within 90 days if they do not notice improved vision. Based on this guarantee, I made my purchase with the understanding that I had 90 days to evaluate the product and request a refund if it did not work for me. After using the product and experiencing no meaningful improvement, I requested a refund within the advertised 90-day period. At that point, I was informed that EverVision’s refund policy is actually limited to 30 days and requires that products be unused, unopened, and in original packaging. This restriction directly contradicts the 90-day money-back guarantee that was used to induce my purchase and was not disclosed at the point of sale. In other words, EverVision advertises a 90-day guarantee to attract customers, but then denies refunds using a conflicting internal policy that materially limits that guarantee. I believe this constitutes deceptive advertising and misrepresentation, as a reasonable consumer would rely on the 90-day guarantee in deciding to purchase. I have now initiated a credit card chargeback for product not as advertised and am seeking BBB’s assistance to obtain a full refund under the advertised 90-day guarantee. I am requesting: A full refund of my purchase price Written confirmation that the refund has been processed I am happy to provide screenshots of the advertised guarantee and the conflicting refund policy upon request.
