Well I have been understanding willing to reach a fair compermise since they were sent and signed the certified letter 8/2021 but this is not happened so I will be doing reviews then a complaint with many agentcys then continuing on from there. We bought this home , we built with Hartland Homes 8/2019 with the plans this would be our last home. It is within a couple of miles from our grandchildrens and caddy corner from my mother who is 65 years old. This home has been a nightmare! walls cracking repaired on 4 occastions , flooring needed to be copmpletely replace 4 times, cracks in the foundation. We kept being told this was manufacture defect on the flooring over and over so we paid more on top of the upgrade cost to make it stop in 2020 yet is continued then walls kept cracking Tim their maintenance guy said oh thatsa normal no it is not not by a long shot , then the ceiling in 2021 we hired an engineer and brought out three truely amazing companys all well known and respected the engineer said the home was built on uncomapcted ground EPP QFR and Thrasher all were close in estimates between 82k to 98k to fix the foundation and the uncampacted ground issue Apple roofing said the roof is good will come back out after the move to check ABC siding was awesome but 38k total siding replacement do to the 2.25 sinking in the southeast corner. We were told by all companies say there will be other cost bringing the whole project to about 150k this home is 2 years old and the street cracked the whole block the city will not fix it until the results come in on the ground. I offered 2 fair offers to start one the fixing of the property or a buy back at what we have in it @ 252k both were not taking by Leah or Andy. We were told they will not fix the foundation! After a google review we received an offer of 232k for the home so not only do they want us to take a 20k loss but not only that but to have to go out to a market that homes have increased 50-60 k in 2020-2021 that is not fair on their part and not smart on mine. So we offered them again a new offer 76k they pay us We release them from any further responsiblity and we would pay 74k put into the cost and we are also responsible for all the unknown there is about 5k-10k in that area . This is a very fair offer to them and for us will just will allow us to keep the home I loved, planned and by the people I care for We help my mother We watch our grandchildren it is where we have to be . The money the 74k is our money we would use to fix the home with the money we asked from them and have not heard a word back I would rather spend this fixing the home with their 76k this could be repaired but if not i will spend this to take this to court and put this out there to warn everyone, everywhere . Leah calls this an act of god that would be the ground moving because of an earthquake etc... this is not an act of god it is neligence if not what was the soil test like the one the city is doing because the road is cracked what was the compaction of the ground? Andy said they removed the top layer wheres the proof of prepairing the ground ? I have all the documents to prove the estimates text messages emails even the warrenty where they extended the foundation warrenty to 2/2022 for show yet declined to do the repair. When I have sent the offers to them I try to put myself in their shoes and think how can we both come away from this not happy but satisfied fairly they come with an offer where they win they repair it they sell it they make more money because they think they can and people can not fight it wrong answer here! They will not profit more off of the stress and heartache we have suffered this is horrible and a bad way to treat people and run a business.

      Hartland Homes Response

      10/20/2021

The movement in the *********** home was due to expansive clay. The city street in front of their house was poured at the new Lincoln standard of 7" concrete to keep it from cracking, yet it has multiple huge cracks in it. The ground under the city street was compacted, tested, and approved by the engineers hired by the city, during development. The movement of the *********** home has nothing to do with how the home was built, the compaction or anything we have control over.
Our warranty team has been to their home multiple times over the years and we personally visited Mrs. ********* at her home to talk to her. While there, we agreed on a solution, which was to wait until the house stopped moving and then we would repair the cosmetic damages created by the movement. By waiting until it has settled, it will be fixed a final time instead of repeat visits. We suggested the waiting period be for 6 months and then we would reassess. All of this, our company agreed to do, even though her one year warranty had expired 13 months ago and there is no structural warranty on the home.
The next week after our agreement, she emailed us and told us she no longer accepted that solution and she wanted us to pay one of 3 companies over $75,000 to fix her foundation OR buy her house for her pre-determined amount. We agreed to buy her house back for a fair price but not what she wanted. Within a week of her rejecting our offer, she put in this bad review instead of working towards a solution.
Our warranty team has been out to the *********** home on numerous occasions, prior to this one, to do warranty work long after the one-year warranty has expired. We have offered several solutions to the current issue, even though our workmanship is not the cause. We thought we had a workable solution but instead received this negative review.
