On June 15, 2022, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11(b)(1)(5)(8)(9) (2020) and Minn. R. 1300.0215 (2021) and the terms of a October 2020 Consent Order. Under terms of this Consent Order, the business agreed to their plumbing contractor license (PC725118) shall not be reinstated or used; the business is prohibited from using predatory sales tactics, including misleading photographs, scare tactics or intimidation when inspecting possible plumbing issues in a Minnesota consumers residence, commercial property or communicating with Minnesota consumers and the business is prohibited from red-tagging a consumers equipment as a sales tactic unless there is a life safety issue that can be fully supported. In addition, Andrew Ryan is prohibited from performing plumbing work unless he holds an active registration as an unlicensed individual and has direct supervision by a licensed master or journeyworker who is an office or W-2 employee of the business. Also, the business has ensure that all individuals who perform plumbing work for the business are properly licensed or registered and are W-2 employees of the business. The business shall also ensure that all future license applications and communications with DLI are accurate and truthful and that all required permits shall be filed at or before beginning work in Minnesota and all required inspections are requested when the work is completed, with any corrective work completed in the timeframe specified or within 30 days. The $10,000.00 monetary penalty from the October 2020 Consent Order is to be paid and a civil monetary penalty of $15,000.00 is stayed on the condition that the business fully complies with the terms of this Consent Order and there are no further violations of any law, rules or orders under the responsibility of DLI.
