      This statement outlines the unprofessional practices my wife and I encountered while doing business with ***** Construction LLC over the past year. On July 16, 2020, we bought into ***** Construction's *********** 2 Condominiums property putting down a required 20% pre-construction sales price deposit. The sales representative for ***** Construction was Nick ********* of *************** Realty. Their contract stated that our deposit, which went into an escrow fund, could be used by the builder for "construction and development purposes". The value, location and community pool (as advertised on ************* website) were our three main reasons for buying this property. My spouse swims for exercise and we also have five grandchildren with who we want to enjoy the pool. In July 2020, we sold our home of 30 years in Gainesville. The condo project was to be completed by September 2020 as told to us by ***************. We made temporary living and job transfer plans to coincide with this completion date.
      Unfortunately, the completion was delayed approximately three months by the builder. This caused us several undue hardships. During the 3-month delay, neither *************** nor ***** Construction initiated any contact with us to provide updates on construction. We had to initiate every inquiry only to be told that completion should be the next month. This went on for three months. Finally, on November 24, 2020 *************** and ***** Construction's Title Agency informed us that closing would be on December 11, 2020.
      We then scheduled our appliances from ******** and furniture in storage to be delivered the day after closing. In addition, we scheduled utilities, cable and homeowners insurance to begin at that time. Two days prior to our scheduled closing, *************** Realty informed us that closing would be delayed until December 20, 2020. We pleaded our situation regarding all the scheduled deliveries/hookups and neither *************** nor ***** Construction offered us any concession for our inconveniences.
      Lastly, there is the issue with the yet to be built community pool. Before we signed our sales contract, we requested confirmation on the completion date of the community pool. We were told that the pool should be completed approximately the same time as our building. On November 14, 2020, we met Ken ***** on our property. We inquired about the pool and Ken told us that at the beginning of the next week he was going to pull the permit and begin its construction. After waiting another 3 months for pool construction to start, I contacted the City of Rockledge's Building Department and was told that a permit for the pool wasn't submitted until March 23, 2021. That is four months after Ken ***** told us that he was getting ready to pull the permit and start construction. We have now lived at *********** for seven months and still no pool construction has commenced. Again, neither *************** nor ***** Construction has initiated contact with us concerning the community pool.
      Overall, we feel that our signing of a sales contract on July 16 and providing a 20% deposit was part of a bait and switch enabling our good faith monies to be utilized by ***** Construction. We have documentation to support the facts listed in this statement. Knowing now the lack of communication, the continued delays, the constant excuses and unkept promises (pool) by ***** Construction, we most likely would not have signed a sales contract with this company.
