  Their were three involved in putting up a 6 foot fence, The contracts indicated that 6 foot fence was agreed upon by all party"s. The problem. started when they placed the back fence to 6 feet 9inches leaving approx. 9inches below the fence. They did not ask my permission to raise the fence that high and I explained to the installer he should not raise that high, I was ignored.. I have spoken to lawyer and he explained that Regional Fence broke our contract. I have spoken to the manager of the fence and he said there was nothing he can do.. I am looking for financial help to fill in the 9 inches below the fence,

  Hello Mr. ********,

  This project included three parties (three properties). We had contracts with each party involved.

  One of the Parties asked out installer on site what grade they would like the fence to be at and one of the parties asked to have the fence raised a bit higher as the property goes on a slop and this party (not Mr.********) was going to block the bottom off himself, and all parties agreed to this including Mr.********. Mr.******** then came back now saying he did not agree to this, we told him that we can lower the fence but all three parties need to agree on this. The other two parties involved did not agree to this so fence was left how it was originally installed. We told Mr.******** that he can talk with the other two parties and if they can come to an agreement we will do what was required. Mr.******** did not want to talk with the other parties involved and just wanted us to lower it.

  I am rejecting this response because: I didnot agree with putting the fence up to 6ft. 9inches. That leaves 9inched to fill in. They painted boards and edging to fill in the bottom of the fence it may look nice on their side  but looks the shits on my side. I told the installer the contract was a 6 foot fence not higher. I had gone back to the regional fence office he knew they broke the contract. I informed myself with a lawyer and he told me the installer breech the contract.   He knows that it would be too expensive for a retired person to bring him to court. I guess I should have put a hold on the last payment. I would not be in this position. I will be informing my self on how to proceed with  the small claims court to get satisfaction if any.
