- Complaint Type:
- Service or Repair Issues
- Status:
- Unresolved
Date of transaction: April 10th, 2023 Amount paid: $45,000.00 The business, Seasonal Impact, committed to provide me with a Bobcat skidsteer as advertised on ******, 2012 T750 Bobcat. The nature of the dispute is that the Bobcat that was listed is not the Bobcat they sold me. I purchased the Bobcat as per the advertisement. The images from the ad show that it is a different machine than was delivered. I did not receive the delivery in person, communications with the business became strenuous when I complained that they sold me a different machine. We never met up for me to sign the bill of sale. I do not even have a valid bill of sale, neither do they, there is no date and no signature. The business screened my phonecalls and I was not able to resolve the issue. The business did not try to resolve the problem or acknowledge that they sold me a machine in no way near as good condition than the advertisement showed. I have so far paid $8,650.58 to restore the Bobcat. Images attached show 2 different machines: IMG3905 is the picture from the ad. The other 2 images are the machine that was delivered. On the white thick part of the 'arm' you can see the decals are shaped differently. The inside mechanism of the track is also shown and it is clearly different from the one in the ad, the delivered machine is also completely rusted as seen in the close up (IMG3963). Attached are the receipts for restoring the bobcat.Business response

While negotiating the equipment only a minor deposit of $100.00 was requested due to the unit being transferred to a different location for repair and maintenance. Once the repair and maintenance was completed it was then transferred back to sale location where the consumer, prior to providing full funds for the unit was able to both view and operate the equipment on the evening of April 10th. He (husband) then provided the remaining funds and the bill of sale was signed. The Unit was sold as is where is as indicated on the bill of sale. (attached).Customer response

I am rejecting this response because:My husband ******* ****** was told to take the machine by *** **** from Calgary Seasonal Impact. Who was instructed by **** from Edmonton Seasonal Impact branch that it was ok for my husband ******* ****** to take the machine home so I ****** ******* can look at the machine and **** would contact us to figure it out the next day April 11, 2023. Full payment was made to hold the machine and in trust that the problem would be rectified. Upon receiving the Skidsteer I ****** ******* noticed it was not the machine advertised and the machine that was agreed on purchasing by me ****** ******* from Seasonal Impact. I ****** ******* was not present and did not sign the bill of sale when machine was picked up. We ****** ******* and ******* ****** made repeated efforts to rectify this problem and was ignored. Both **** and *** knew that there was a problem.
The signature for the buyer on the bill of sale provided by the company Seasonal Impact was not signed by me ****** ******* or my husband ******* ******. That is neither of our signature or writing on that bill of sale.
Sincerely,
****** *******
