Franken Homes built an infill home next door to ours in 2020 and completed the landscaping in 2021. On June 20, 2020, we saw that large windows had been leaned against our fence, and the fence was starting to lean. I phoned the company owner (Ulco Franken) and he told me they would get the windows moved and fix the fence. They moved the windows, but did not fix the fence at this time. On August 3, 2020, a chain link fence section was leaning on our fence, and we saw that some fence boards were pulling away from a fence post, forming a gap. The next day, we met with Ulco, and he looked at the gap and said he would have it fixed. On August 27, 2020, my wife ***** emailed Ulco as follows: "I also would like to have it in writing in terms of summarizing our previous discussions: 1. Your company will fix the grade of our side yard which collapsed/eroded into the excavation at **** ***** before backfill happened. 2. The fence we share with **** *** ** is caved and broken likely due to various things leaning on it during the construction of **** *** *** Your company will repair the fence." The same day, Ulco replied, "Yes to both of your questions that we will fix the fence and the grading." This was not reported to BBB earlier because we had assurances that the fence would be fixed in 2021 when the construction company completed the landscaping. The grading was fixed, but the fence never was. I left voice mails for Ulco Franken on September 3, 7, 14, 17, and 23, 2021, threatening to file a BBB complaint on September 17. I have left him time to reply in case he was on vacation, but one month later, have received no reply.
