Our car was hit while parked at my husband's work. 100% none fault. Insurance recommended Chapman's and our car was taken to their bedford location. It sat for several months as they could not get the parts. When the car was repaired it was returned to us with bad brakes as a result of the car sitting so long without being driven. Chapman's said to put it through Insurance. Insurance refused. Their position was it was not damage from the accident and Chapman's should have moved the car around the lot to avoid the brakes seizing. It is worth mentioning the car had a brand new safety inspection just prior to the accident. After a lot of back and forth with Insurance and Chapman's they agreed to take the car in and do the work. They picked the car up did the job and delivered it back. No mention of money. A week later we had a call saying they forgot to ask for payment but we are supposed to cover half the cost. I refused as this was not discussed and I had not caused the damage. Yesterday I had a phone call from a collection agency. They sent the 103.50 to collection and I am furious. This is going to ruin my husband's credit. I had no control over the car while it was in their care and it was returned with damage that was not there when they collected the car. I am probably going to pay the collection to protect my husband's credit but I would like this money refunded and any negative marks on his credit repaired. They have both mine and his name on the account but the person from the collection agency said it is likely to impact his rather than mine. I believe the company had a duty of care with regard to our vehicle and if there was an expectation of payment this should have been discussed prior to the job being done, not a week later.
