Out of 23 bids, I was high bidder for a firearm advertised by Caroline Colt Co. Their ad stated, 'Colt Model PYTHON Revolver RARE 3" COMBAT 357 Mag 1972 MFG Excellent. According to Colt MFG, This 'HIGHLY COLLECTIBLE', 'RARE' firearm is nothing more than a Parts Gun that has had the barrel changed from 2 1/2 inch to 3' by someone in order to attract a higher sale price. . I gave them every opportunity to make this right by refunding what I paid them, Caroline Colt Co. made it clear they would not refund me and blocked any further communication. This was NOT a mistake. They intentionally mis-represented this firearm. In my state this constitutes FRAUD. It amazes me that a business would trade customers and reputation in order to cheat someone out of an extra dollar. Remember- it ISN'T slander when you use THEIR exact words-which I cut and pasted here. I have their enitire advertisement available as well as all correspondence by e-mail. Their arguement is the gun was advertised as a 3 inch Python and that is what I received. What they fail to address is it is a 2 1/2 inch Python that has had a 3 inch barrel added to it, It is NOT rare, it is NOT a combat python, it is NOT highly Collectible, it is NOT a Top Tier Collector Piece. I PAID $4,255 . If advertised correctly, the value of a 'Parts Gun' would be $1,200--$1,500 Max. This was a blantant rip-off by them.

Caroline Colt Company - The Shootin Shop Response

9/15/21 Customer ****** purchased a Radom Hellpup Pistol, Order number XXXXXXXX, one of our listings on GunBroker.com.

9/16/21 Pistol was shipped by FedEx to Shoot Wise, customer's FFL dealer in Louisiana, with tracking number XXXXXXXXXXXX which was provided to the customer that day through email.

10/3 Customer ****** emailed asking for the tracking number to be sent again. This email was received after hours and was responded to on 10/4/21.

No further contact was made by customer. We were not made aware of this issue until we noticed a complaint on our BBB profile. If we were informed sooner, we would have been able to dig into It while it was still recent and would have been able to file the required claims and reports with the ATF in a timely manner.

As of the time of this response, a claim has been filed with FedEx and a lost/stolen firearm report has been made to the ATF.

I'm the customer, paid for your item. You were aware on 10/4/21 as stated above. So where is my refund? I didn't do anything wrong. You guys didn't tell me a claim was filed. Communication needs to be better.

A trace was initiated on 10/4. Upon not hearing from anything from the customer it was believed that the package was delivered after the in transit delay. The claims that were filed were not done so until this report from BBB was received on 1/7/21. If the buyer had communicated this sooner, rather than two month after the fact, the chance of recovery would have been greatly increased. It Is true that communication could have been better. It is hard to solve a problem that we did not know existed.
