I engaged *********************** ********************'s domestic search firm to find a housekeeper in August. Ms ******************** will not honor the terms of our contract, and I am seeking a refund of the $2,500.00 retainer, which was to be applied to the placement fee when a hire is made. In refusing to present the 3-5 candidates that are provided for in the contract and by placing significant constraints on the trial period (which are NOT stipulated by the contract), Ms ******************** has made it impossible for me to hire for this position, rendering my $2,500 retainer lost. Under the service agreement dated 8/19/23, I am to review up to 5 qualified candidates. Qualified means that these individuals have the skills and availability to do the job as advertised, and "candidates" means that these individuals are seeking my employment. I interviewed one candidate who, after the trial period, declined to perform the duties of the position as advertised. Ms ******************** made me aware of three other individuals who removed themselves from consideration before an interview took place. Because these individuals were invited to an interview and declined, they do not meet the definition of a "candidate" for my position. The service agreement also affords me a "two-week trial period" for any 3 candidates I select. I used 5 of my trial days on the single candidate that Ms ******************** presented and should have another 5 days to trial additional candidates. However, Ms ******************** is asserting that this two-week trial period is now limited to 3 hours for use on one candidate. This position regarding the trial period is not substantiated by the service agreement and significantly reduces my ability to fill the position successfully (even if she were willing to present more candidates). Under these circumstances, I am not able to make a hire and cannot realize ANY value for the $2,500 retainer that I paid. Ms ******************** is keeping my money without fulfilling her obligations under our contract, and I'm appealing to the BBB for help. Thank you.
