    On January 15th 2024 my wife and I agreed via emails to purchase and have **** Nicely of Nicely Installed and Serviced HVAC install a furnace, heat pump, tankless water heater, spit zone ducting, humidifier, and hepa filter for a total of $42,212.20 and the work taking 10 days to complete (1) (2) (3) (4). We paid $8,190.00 on Feb 13th and he began to install duct work at our house (5). We paid an additional amount of $25,220.44 on Mar 3rd for the equipment (6). Work and communication stopped after this payment and it wasn't until June 11th that we got any equipment and work resumed. We paid an additional $3407.38 on July 2nd after the tankless water heater installation was completed (7). After that payment I emailed **** to let him know that per agreement we owed $5394.34 for the completion of the project and he agreed (8). Sporadic work continued for a bit, but the last time **** did any work at our house was August 29th.We then started to get bids for completing our HVAC and had 5 HVAC companies come and look at our situation. (10) (11)(14)(15)At this point we have paid Nicely Installed and Serviced HVAC a total of $36,817.80, waited over 9 months, and he has only completed the tankless water heater; we are without heat at our house, without the bulk of our remodeling funds, and get no response from ****.The balance we would have owed **** for our completed two-zone system was $5394.34 and the balance we would have owed him for a completed single-zone system was $2,194.34 (3). **** also did not pay the the electrician he hired, so since I will need to pay the electrician, I am subtracting the $1,050 (2) we paid him for the electrical work.Hence, we would owe **** $1,144.34 for a completed single-zone system and because we are having to pay a different company an additional $17,117.31 to get one, we are asking that he pay us the difference of $15,972.97.Note: the parenthetic numbers refer to supporting documentation.
