    I felt desperate and needed to move so I found an apartment on line. I never stepped foot into that place nor did I have a key. When the murders took place in ******, ***** I was very much afraid. I have debilitating anxiety and I broke the lease. On February 16, 2023, I paid $1406.76 just to break a lease and I am a widow on Social Security only. My family did not want me to move where I would have no help or family close by to help. I am trying to get a refund back from my lease as I do have a letter from my dr stating I was in no mental condition to make any financial decisions in my life.

    My name is ******************* I am the regional manager for DABCO Property Management. I have been in contact recently with **************** to help her with her concern. All the properties DABCO manages follow a very similar lease. In the lease it is very clearly laid out how you go about breaking a lease at different points of time, including before you move in. I have attached this page from Ms. ******* lease. We are very strict about following fair housing laws and making sure every resident and potential resident is treated equally, and we are following all laws and regulations. There is a fee to break a lease because there is a loss of money to the property, and we need to help recoup that while we get the apartment rented. When **************** came to us to terminate her lease, she said nothing about reasonable accommodation,which is what she is asking for now. There was no talk of a disability which would have triggered a conversation about accommodation. A reasonable accommodation would have been the process to get her a lease termination without a fee if she could provide the correct documentation and it was approved. We do not go back and return money after a termination a year later. If she had come to us in a reasonable amount of time it would have been considered. In my last email to *************** and her representative I told them I would report her situation to our COO, but with a delay of a year since her termination her request was denied. I am reaching out to **************** to see if she would like to talk to our COO for more understanding. If you need more information or need me to do anything further,please let me know.

    I am rejecting this response because: What money had to be "recouped" from me breaking the lease? This apartment was not available until January of 2023. I did not see the inside of the apartment, no furniture was moved in, and no keys were exchanged. Shame on you as I asked that I be excused as the murders had just happened and was told that was not a good enough excuse! I am a 71 year old widow and that was a good reason, I may understand keeping a month's rent, but $1406.00 was more than I had and had to borrow on my car to get it and am still paying for it!

    We appreciate your concern and always look forward to feedback from residents, and potential residents. Because the lease you signed clearly states how you terminate a lease even before you move in, we legally must follow our current policies and procedures and treat every resident in the same way. The section from your lease about terminations is attached to this complaint.

    On 02/10/2023 Dabco illegally terminated my new lease agreement and would not allow my wife to co-sign and have not given us a legal 60 day notice of non renewal.Also they moved me during Covid in April of ****************************************************************** for not wanting to move so they can do up grades to my apartment.

    Thank you for the opportunity to respond. I met with **************** on February 8, 2023, via telephone. We had a very nice conversation and I thought we had a mutual agreement to meet to show him a few options of available apartments should he choose to move before the end of his lease agreement to assist us with an upcoming construction renovation project to install washers and dryers into his building at Pine Ridge. In fact, **************** had made plans to meet with our Project Manager on February 13, 2023 @ 5:15PM to look at the apartments we had available.

    Because of the conversation and the scheduled meeting, you can imagine my surprise to learn that on Friday, February 10, 2023, at 11:30AM that **************** was upset because the staff was not allowing the completion of a renewal of his current lease agreement. I pulled the entire staff into my office at noon and had all involved explain to me the timeline of events to better understand what the issue was. ****************, stating that he had planned to work with our Project Manager on a potential move, then telling me he was interested in looking at available units, while then going to sign a renewal on a lease that was not eligible for a renewal due to construction.

    Unfortunately, all of this could have been rectified through consistent communication. **************** did receive a renewal letter which was a blanket letter letting residents know that if they chose to renew prior to the rent increase that their current rent would be recognized. However, we are unable to renew lease agreement in building slated for construction. Prior to this letter **************** received an email (I have attached it for your review) that gives the options and clearly states that if he chooses to stay in his home through the end of the lease he would not be eligible for a renewal. This letter was sent to **************** back on December 10, 2022, which is well more than the required 60-day notice. 

    The owners of the property have secured funds to add washers and dryers to their apartment buildings. Letters went out to all residents that this project was taking place. In fact, **************** had moved once prior to now for the same reason. I was surprised he was moved into another building that was to receive the same construction which would eventually require another move after the completion of the lease contract. If a resident chooses to live out their current lease this is not an issue. Residents ARE NOT REQUIRED to move until the end of their lease agreement. I hope this helps to close out this inquiry. I have offered to personally meet with **************** to work toward a resolution to all of this but he sent an email earlier today cancelling any scheduled meetings. I hope he will reconsider so we can rectify this amicably.
