    I have lived here since **** The management company assessing fines to me for my yard waste can and the location where it has been stored for all of these years. I have attempted to resolve this with **********;****. I have been fined twice $100 each. Specifically, here is the section in question. in Section 5 of the ***CCR pdf file you provided, it addresses the storage of the cans. It says, "No trash, garbage, refuse or other waste materials shall be kept on a Lot except in containers which are regularly emptied with contents disposed of off the Subdivision. All equipment or the storage or disposal of such material shall be kept in a clean and sanitary condition and out of sight."In my attached documentation, **** has added bolded words in an effort to make it appear that the document states that the garbage can location needs to be in a garage or behind a fence. She has added these words and is misrepresenting the official documentation to her advantage. When I received the first notification of a fine, I requested a dispute on the charges. **** has added another fine without us reaching any solution or conclusion on my dispute. In addition, I am now getting additional notices about my home such as **** on the roof. Once again, she has added words to this description to mis-represent what is actually stated under this same section 5 listed above. I have asked again for a hearing with the *** board to dispute all charges, but at this point the Management company is threatening me with additional fees to include a lean against my house. I am not getting anywhere on my own and am beginning to feel anxiety over the thought of losing my home and or being fined excessively without ever being able to resolve this. I feel I have no power in this and I am now being personally attacked by whatever power **** and the management company feel they can do to me because I am questioning her interpretations and unilateral decision, making process.

    I am ********************* with CM&M Property Managment and we have been the property manager for **************** for about 12 plus years.  We did send the complainant violation letters regarding a couple of issues in violation of the CCR's.  We work at the direction of the **************** ***** of ********** We address issues from the CCR's and were asked by the **************** ***** of ********* to address garbage can violations.  When the complainant first reached out, we sent a photo of their situation to the board, and it was determined they felt it was indeed a violation of the CCR's and to continue with the violations. 

    They did ask to speak with the board and we worked to arrange that and had a meeting with them.  This did take a bit of time, as board members are volunteers.  I did acknowledge to the complainant, that I could have provided a bit more communication that we were looking to schedule.  At that time, we were informed the issue of the roof cleaning was resolved and that matter was immediately closed (no fines were assessed).  They discussed with the board that they felt the issue was being addressed to harshly and the board agreed to review this issue over the next couple of months to clarify for all owners the intent of this issue. In the meantime, the complainants' fines were waived and they were advised we would get back to them with additional information once the board can do a complete review of this issue to include all 5 board members.  

    It was after that I received this complaint but it was dated before that hearing date.   I do believe this issue has been resolved for all parties and hope this complaint can be dismissed against CM&M
