I notified the company I was moving out. I asked for a copy of my move in check list and did not receive a copy. After move out i received a check and with it had deductions along with a notice of we can bill you until infinity. I notified the company during my stay I had a contractor fix and paint. No issues. I turned in my keys at the end of December and I received pictures after being ignored for another copy of my move in statement which I am entitled to by law. No response. I moved due to a domestic violence situation. The move out check list was never provided along with my requested move in check in. The pictures showed the date on the checklist had been ****** out. They charged over $400 to carpet clean 12 steps. We spent hours cleaning and were charged for more cleaning. We had prepped my sons room for painting. I had lived there over 5 years. They charged me $500 in blinds. However all blinds worked and are not that costly. I to this day am unsure what I was charged for. I was responsible for the unit apparently after it rained and should have gone to sweep the front every day. I was charged for that too. I moved in January and was told by a woman named ****** to email her for a paper trail and every email would return, every phone call got no return call. I have not heard from them. My mom signed an original lease as a co-signer but nothing more and they have been harassing her. She has not taken any sort of responsibility for the place in years. I have a $1900 bill without any response to my questions. The unit sat empty for a month and that is what rent is now. I feel like I am being charged for the month the unit sat open. Windermere has not provided with any communication or documentation within the legal time, not only that if a woman leaves a place due to domestic violence its illegal to keep the deposit.

      Business Response

      Date: 06/29/2023

      Good Morning,

The documents requested were mailed to the tenant when requested following move out. The mail sent was delivered back to our office as "not deliverable" and the tenant was notified via text that the mail was available to be picked up in our office. No response was received and the tenant did not come to the office to pick up the documents. Photos from the move out were shared to the tenant portal to show the poor condition the paint was left in. The patches throughout the entire unit caused a full paint, it was not just one bedroom effected (photos were shared via email to the tenant following move out). The carpet cleaning charged was the minimum fee of $100 per the lease agreement and cleaning was performed due to certain areas in the unit not having been cleaned well enough for a new tenant. All of this can be seen in the photos provided to the tenant following move out.

I have attached the tenant ledger showing the separate charges as well as the move in condition report/lease documents from time of move in. No rent charges were charged to the tenant following her move out at the end of December.

I can remove the broken blinds charge of $374.21 since the tenant had lived there several years.

      Kind Regards,

      Complaint: 20252791

I am rejecting this response because:
I had requested the check list in 11/2022. I have other documents that I am unable to upload at this time. I have had multiple items forwarded to me, I received the letter where they happened to temporarily withhold a certain amount of money, we also received the check therefore Im unsure how this is a valid claim, unable to forward when I continue to get forwarded mail. The carpet cleaning was for 12 steps. I have more picture where the home was clean and there is no way the amount of time it took to clean is accurate along with the cost being extremely high for Ferndale. I have had my home cleaned for $30 a hour.
I did not receive an itemized statement. I attempted on multiple occasions to reach out and my emails were blocked or the sender was not working. This woman would not return my calls and its all documented. In Feb I filed a complaint with the attorney general however they do not do rentals and gave me a list of resources. I could not afford to go to court as Windermere was not honoring my rights as a tenant. Who take until February to send a move out list. The move out check has white out over the date and I do not know what date the unit was clean. I saw the cleaners leave on day 24 after I moved out shortly after it was rented I received the bill. There was a lot for paint when a 5 gallon costs $250. The walls were patched and prepped by a contractor. I could not afford the paint to finish painting. I was accused of having barstools outside and asked for proof and then nothing appeared. I was charged over $100 for hauling. My lease said $68 but Im not sure what they hauled. They cleaned the communal trash hole and billed me. I had lived there since *** was the manager and then I never again had a manager to report things to like teenagers running through the yard. I reported to the police. I lived there from 5/2017 until 11/2022. According to HUD the unit needs to be painted or lasts 5 years. It was not painted prior to my move in. The blinds were broken when I moved in. The bathroom blinds were rusting when I moved in. After 6 years things need to be taken care of and not at the expense of the tenant, there was damage that was due to living there 6 years. I did sign a new lease in 5/2018. So the which lease is valid?
With the mail that Windermere managed to mail without issue, I mean why not put it back in the mail to mail it as that is illegal with holding of mail, I believe the money that was already held covers the expenses. If people are dodging calls and playing with emails then how do you get a hold of them with limited means? There were birds that built a nest in the laundry vent and I asked for it to be taken care of, it was taken care of at move out. Im glad the property didnt move down. The money withheld is enough since I was there for over 6 years. I moved because my rent went from $1250 to $1600. With no improvements in anything.
      Sincerely,
