Hi,I ordered fan replacement install from unscrupulous electrician. He came to my house and demanded me to pay $130 to replace electric fan before the wait is stated, with zero payment after the work is done. I agreed to his unethical demand and paid him $135 as he demanded $5 more for cashapp transaction. He removed my older fan. But he refused to install new fan. He asked $80 more to install the new fan, making the total as $215. I agreed to this demand as well. Then he refused even that and left my house without installing the new fan, leaving the room without fan or light in this hot weather. He had zero concern for my well being or safety. When I asked for current license papers to show that he is legally allowed to work in ******** as of this morning (6/29/2024), he blocked my phone and never picked my call or message. I request full refund of the money I paid to him. I have video recordings from my ring camera about his entering, leaving etc. I am requesting full refund of the money I paid to him. Please see the attached. Thanks

    Dear Dispute resolution team,

For your ready reference here is a copy of customer complain

(Hi, I ordered fan replacement install from unscrupulous electrician. This in respond to the above complaint ID ********, the customer responds to my ad regards ceiling fans. I went to the customer house on June ******* at ****** and leave the property at 11:53am not including travel time.  When enter the house the customer starts to mention serval other work that he wants done including over 8 recessed lights, serval dimmer switch and 2 other ceiling fans.  the customer going back and fort and do not want to pay the quote price for the above work. After all that time discussing the above work, he decided to only replace 1 ceiling fan. So, I write up the contract.

First of all, He lie again said I demanded payment. That is false information.

I did not demand any payment from him and he was well aware that the payment is due when sign the contract and start work, (please see text message) also by phone conversation he agree to pay cash.  He then read the contract fully and completely understand everything in it I even answer all his question, he agrees to the contract terms, initial it then sign and date.

By phone he agrees to pay $130 cash however when its time to make the payment he changes his mind and want to pay by cash app. At that time, I explain that a fee will applies when customers pay by cash app because cash app charge me a fee. He agrees to pay the $5 extra. That is the reason why he ends up paying $135 by cash app.  Again, I did not demand any payment

The customer ********************************* dishonest, and lie and falsely accusing me by willfully and intentionally proving misleading false information to the Better Business Bureau without stating the facts of the matter. For example, he willfully and intentionally did not mansion the facts and the truth as to Why $80 extra was to be charge, but did not charge. And the reason why I was force to leave his house.

    FACTS

There is a paragraph in our sign contract stated.

Price may increase and or stop work may occurs  Initials required (please see contract)

Meaning in this case it applies to the customer

He is paying $135 to only Take down the old existed ceiling fan from the ceiling. Then Assemble the new ceiling fan and install it the same place the existed fan comes from.

    Important:

Please Note: When I remove the old existed ceiling fan. Then is when I discover that there is a major dangerous electrical code violation that someone could seriously injury or get kill.

Yes someone could of die. The existed ceiling fan was just in the ceiling loose. And was about to fall out of the ceiling at any giving time. The existed ceiling fan WAS NOT installed on a electrical FAN BOX requires by code. instead, it was illegally installed on some type of thin wood. (Please see attached picture.)

At that time, I call the customer and his wife in that bedroom and explain to both of them and show both of them the code violation. I also show them the new ceiling fan, - the part that connects to the ceiling. And I explain to them  that the new ceiling fan MUST install on an electrical fan box ( Please see picture of the new ceiling fan.)

Also please keep in mind that when I took down the old fan. I expect a ceiling fan box to be already in place to install the new fan on.

At this point this becomes a change order.

Meaning there is a problem that needs to be fix. If he wants me to fix that issue there going to be a charge of $80 including material and labor. Or he can get another contractor to fix the issue within a reasonable time so I can come back and finish install the new ceiling fan.

At that time the customer gets upset and started to screaming and yelling at me, calling me names, and telling me to get out of his house.

Please note for safety reason at that time I remain calm and polite and explain to his wife why its a charge to fix the problem. While he is still being rude his wife has to keep telling him to stop.

He still arguing and do not want to pay the $80 extra for me to fix it.

per our sign contract same paragraph customers has the option to have someone Eles to fix the problem at that time I place a STOP WORK order and give him reasonable time, 5 business days fix the code violation. When the problem fixes, he needs to let me know so I can come back and install the new ceiling fan.

His wife then escorts me outside the door I tell her I have to give her a stop work order so I will be outside in my car writing up the stop work paperwork.

When I finished write up the stop work order his wife took some pictures of the stop work order  at that same time before I drive away from outside their gate, I send the customer a copy of the stop work order per our sign contract agree.  (Please see copy of text message) the customer successfully received on his phone 2 image in the text message one with the stop work order and the other with the picture of the code violation.

Finally: The only person in this case that are unscrupulous and unethical is the customer ********************************* That type of customers are the reason why we to CONTRACT into place because those type of heavier will not be tartarated.

I leave the house because a stop work was put in place and the new ceiling fan has no fan box to install it on. Customer also lie said he ask to see license. At no point the customer ask me that question.

Customer lie and make up that store about ask me to see license. He makes up that story only after I send him the text message with the stop work order and because its a very serious code violation, I also request him to make sure have a master electrician install the fan box. So, it can be properly installed when I return within 5 business days. (Please see text message.)

After I leave his house, he started the harassment by phone and text I explain to him about the stop work and to have the problem fix in 5 business days. and ask him to stop harassing me I also advise him that Im going to temporary block his number because of the harassment and lie, and false information in his text. I place a temporary block one phone number he keeps calling and text from other numbers. (Please see text message)

Appropriate action is still pending in those harassment and false accusation case. He only stops when I told him that I will report the matter to the police. With respect to everything being said in additionally to breach of contract the customer actually has a balance due of $5 (Please see text message.)

Thank you for time BBB Dispute resolution team,

    Respectfully Yours,

    Michael Henry
