    We executed a contract on August 3rd 2023 with Shoreside Concepts, owned by **** *******, to complete a backyard project that included hardscape, an exterior structure, landscaping, and a fence. The contract price was $274,800 with milestone payments including deposit, start, 50% complete, 75% complete, and final payment. The final payment represents 10% of the contract value. The project was to be completed in May of 2024 and as of September 2024 it is not complete due to poor project management, cashflow management, among other things on the part of **** *******. The project is roughly 85% complete and we have parted ways with **** as we lost faith in his ability to complete the project. We have had to hire alternate contractors to complete the fence, irrigation, landscaping, trim carpentry, etc. Our specific complaint is that in early August **** informed us that if we didn't prepay a portion of the final payment to him he would not be able to complete the project. On August 5th we provided **** with a check for $6870, representing 25% of the final payment, with his commitment to use the money specifically to complete the irrigation system, fence installation and landscaping. He cashed the check and after over a month still had not completed any of these items. In response we parted ways with **** and paid alternate contractors to complete these items. We would like this money back from ****.

    We did install the landscaping as well as the irrigation.  The irrigation was missing only the control wire that needed to go to the timer itself.  The costs on the project ran over quite a bit on us vs the original contract amount.  We did and have been doing everything in our power to complete the project and stick to the original price agreed on.  Upon the customer deciding that they no longer wanted to use us to finish it for the remaining balance, I suggested they get quotes from others to weigh the cost needed vs the balance which should of all been very close.  We are not in any position to refund any payments and we still had an outstanding balance with them to complete the project.
