    Per HUD FHA Loan Regulations, all borrowers, whether they are occupying the property or acting as non-occupant co-borrowers, must be listed on the title. This means that anyone obligated on the mortgage note must also be listed on the property's title and If a spouse is on the loan, they must be on the title, and in some cases, even if they are not on the loan, they can still be added to the title. I am alleging Saddle Creek Title failed to follow these statutes. Per HUD and FHA Loan Regulations, I am clearly listed as a co-borrower for this property, via the Deed of Trust [ATTACHMENT E] , and Assignment of Mortgage [ATTACHMENT F]. It was recently discovered, my name and/or recognition as Edwardss wife was clearly and intentionally omitted from the original Warranty Deed without my knowledge and/or permission. However, it was noted that asterisks (*) were placed after ******* last name (in two places on the deed, but fail to denote a clear meaning and/or reference. In an effort to gain clarity I was told per Saddle Creek Title since I am not listed on the Warranty Deed, I am not listed on the Title Insurance. I vehemently refute the actions and assumptions of Saddle Creek Title and am asking for assistance from your office to gain clarity regarding the following questions: a) Since this was and currently remains a HUD FHA Loan, shouldnt my name have been listed as an co-owner on the title since I am clearly listed as a co-borrower? b) Were the asterisks intentionally placed after ******* last name? If so, what do the asterisks denote and where is this clearly listed?c) In lieu of HUD FHA Loan Regulations, why was my name omitted as an co-owner yet I am clearly listed as a co-borrower on the respective fully executed documents?

    Saddle Creek Title did not represent ******** or ****** ****** in this transaction.  Select Title & Escrow in Southaven ** represented the Farleys.  Saddle Creek Title only represent the *******, ****** and ******* ********.  While Saddle Creek title did prepare the Warranty Deed as part of the closing process on behalf of the sellers, the vest of the deed in the name of ****** only was done at the request of Select Title and in accordance with the terms of the purchase and sales contract.  Moreover, not only is it NOT a violation of any *** regulations, it is actually very common, especially in the case of a married couple, for a borrower to be listed on the loan and deed of trust only and not also as an owner on the warranty deed and title insurance policy.  Saddle Creek Title would be happy to assist Ms. ****** to the extent possible, but I would suggest she contact Select Title & Escrow for assistance with this issue.
