This is the email I sent to the dealership, they sold me a car 60 dys ago and thogh the warranty of 30v days is out of service, I have been researching because there is major internal damage to this car and it is not operational. ****** ****** ************ 12/29/2022 2012 Mercedes Benz E350 : Applicable Lemon laws for used cars Bobby and company, Please find enclosed information under the annotated laws of the state of South Carolina. Unfortunately, the vehicle you have sold me is within 60 days (about 2 months) of purchase and is completely useless in its current state. I attempted to get some help from your organization to which the owner responded “I can assist you with googling some information” when it was brought to attention that this car has major internal issues. Though the 30 warranty is no longer active, there are laws in the state of South Carolina to protect consumers. I have contacted an attorney to further explore the laws that apply to this situation. There is some protection afforded to consumers regarding used car sales such as the Soth Carolina unfair trade practices act of 2015, the federal magrouson-moss warranty act, and the federal truth in lending act. My only request was that this be corrected, however, after no response from your company I feel that I must secure assistance in this matter. If you wish to resolve this matter before any further legal action is invoked, please feel free to reach out. Title 39 - Trade and Commerce CHAPTER 5 Unfair Trade Practices ARTICLE 1 General Provisions State Protections for Used Car Buyers in SC SC law requires car dealers to honor the terms of warranties – and it establishes that all automobile sales include an implied warranty unless the dealer sold it “as-is.” But, even if you bought a car “as-is,” that doesn’t necessarily mean you are out of luck. Under SC law, you can file a lawsuit against a dealer who sells you a used lemon. Under the SC Unfair Trade Practices Act (SCUTPA), if the court finds that the unfair or deceptive methods that the dealer used were willful or knowing, you can recover 3x your actual damages and your legal fees. Federal Protections for Used Car Buyers The Federal Trade Commission (FTC) requires anyone who sells a used car to provide the buyer with a buyer’s guide that includes the vehicle’s warranty information. The FTC requires that the guide be attached to the vehicle and include the terms of the warranty and list any maintenance or mechanical problems. If the seller fails to do this and the car is defective, you may be able to return it
