    Contractor gave a fixed price of $32k to do work on my pool house...change trusses to rafters, extend roof 4 feet, put a new roof on the pool house and side the 3 interior walls with cedar. At the time of the quote, it was undecided whether i was going to have him clad the 3 walls with cedar or use the masonry contractor on the job to use stone. I decided to have the masonry contractor use stone. When i made the final payment to Lance Smith LLC, I accidentally overpaid, making the total $32,500. The total amount should've been $32,500 minus $6,180 ($500 overpayment plus the credit of $5,680 for the siding of the 3 walls which he did not complete). I'm seeking $6180 to be refunded to me by the contractor.

    Note that after discovering the overpayment (realized it when i paid the masonry contractor their final bill), I tried to get ahold of Lance S**** (owner of Lance Smith, LLC), but he didn't return calls for several weeks. When he did return my call, i explained the situation to him. He acknowledged that his $32k agreement was to include the cladding on the walls. He was in transit and said he'd get back to me. He never did and won't answer or return calls.

    There were several other problems on this project:

    -agreement was to include disposal, but i let him burn some wood products on site to save him money...he also included noncombustible items in the pile which i still have to dispose of

    -I checked on status when he was doing the roof. He was literally hammering in the last shingle and the told me that the roof he just put on was actually a different color than the house because he "couldn't find the color to match"...no mention of it before

    -The masonry contractor and i reviewed the scope of work with him prior to the bid. We agreed that he'd have to remove the masonry layer before tying in to support the rafters he was adding. Did not do this. Consequently, Interior ceiling is a different pitch on each side as a result.
