    I signed a contract with Scarantino Contracting on March 1, 2022 and gave him an $8,800 deposit for supplies to install a paver sidewalk, paver patio, and **** deck. As he completed each project, I would pay him the labor charges. Almost a full YEAR later all I have is a half finished deck that is poorly constructed. For example, one of the posts for the railing was placed in the middle of a window and he didn't realize it until he went to connect the railing to the house. After a year, and poor quality of work, I did not want him to do any of the other projects. Once the deck was finished, I would owe him $3000 for labor. So he subtracted the cost of supplies and labor for the deck from the deposit I gave him and gave me a check for the difference. However, the deck is not done, yet he's keeping the $3,000 in labor costs. I've texted him multiple times with no response. I feel he has no intention of finishing because he already paid himself out of the money I gave him a year ago. I have also requested a 20% reduction in labor costs due to the misalignment of the post that ended up in front of a window. This is not what I signed off on. But again, he keeps ignoring the issues. And of course he can because he has all the money as if the job is complete.

    Dear *** *******,

    A contract was signed on 3/1/2022 with *** ********* for requested services. No start date was set at that time. She was informed it may take until spring to even start the work and she was fine with that. 

    A deck was to be constructed on the home and to be centered on the rear sliding door. The only change was the stairway was to also be centered but a request to move it to the right was done. All phases were viewed and approved as constructed. The deck was completed on February 7, 2023, with her present.

    She was only charged for labor and deck materials and was returned a check in the amount of $ 3,222.00 on February 2, 2023 prior to completing deck. This was a portion of the other part of the contract of which I had already purchased materials for. 

    Upon my leaving the property she proceeded to post slanderous comments and a flyer with my photograph, on ******** and social media immediately. Said flyer she stated would be posted around town, of which a few have already been seen. Upon seeing this council has advised me to cease all contact.

    I am rejecting this response because:

    In *** **********'s response, he indicates the deck was to be centered on the rear sliding door.  If you look at the picture attached, this was not done; the deck is not centered on the sliding door.  In addition, he admitted early on that he made a mistake in aligning the post on the left in the middle of the window.  If the deck were actually centered, the post would not be in the middle of the window. I did NOT sign off on a drawing with a post in the middle of the window!  I also did not approve the final construction and he is aware I was very unhappy with the final product.  On what I realize now was his last day to do any further work, he handed me a check to refunded my money in the amount he thought was appropriate, and I have never seen or heard from him again.  I requested multiple times at least a 20% return in labor costs due to the post in the window. He refuses to respond.  He also refused to provide any receipts for the deck materials so I have no way of determining if he charged me appropriately.  He even told me to register my own deck materials on-line in case there is ever any issues.  He clearly isn't standing behind his work. I've had other contractors do work and they always take care of  registering products used and gladly gave me the receipts.  He is a shady contractor and the public should be made aware.

    I am rejecting this response because: After getting quotes from other contractors to complete the job he didn't finish (adding end caps around the entire deck and both step end, and installing facia board as was requested of *** ********** during the building process) $600 will not cover these costs.  I will be willing to settle and sign an agreement with *** ********** for $1,000.
