    This marketing company obtained personal information without direct permission from me. They notified me by letter of a data breach involving my information and put the entire responsibility of protecting my credit on **** have called multiple times but have not been able to contact anybody with authority. A supervisor is supposed to call, but that does not happen.Since this company cannot hold information safely and offers no benefit to me, I want them to completely and permanently remove my information from their system. This should be easy - my name is unique in the country (which increases the risk to me when personal information is released).

    Good Afternoon,

    Encompass Elements cannot delete the information at issue, which is the consumers name and birth date, due to document preservation obligations attendant to potential future litigation. This obligation has been communicated to the consumer multiple times, and Encompass Elements has taken steps to rectify the situation by transferring the information from its servers to a secure physical drive disconnected from our network and the internet.  Thank you allowing us to respond.

    I am rejecting this response because:

    1. I was never informed that there was an obligation on the part of the company - which I doubt because there does not appear to be any government agency regulating it. An internal policy is not a legal obligation.

    2. The company (and any other company where they have sold my information) are not protecting my data. I am asking for an option: opt out, inactive status, or some other means to keep my information from being used, sold, or otherwise put in jeopardy. This business is a hazard to citizens and should not be allowed to continue using private information without also providing a way for individuals to be protected.

    This is our response to the complaint

    Encompass Elements and it representatives have communicated with Ms. ******* on this topic multiple times.  We received her information from our customer to support a customer mailing.  We do not sell this information to anyone.  The only information that we have of hers is her name and birth date.  As explained to her multiple times. we can not delete all copies of the information at issue due to document preservation obligations.  However, Encompass Elements has taken steps to rectify the situation by transferring this information from its servers to a secure physical drive disconnect from our network and the internet.  As this message has been given to her multiple times already, this is the last message Encompass Elements will provide on this topic.  Thank you
