      In 2016, the Dwyer Company performed work at my current house to include installing a drain for our downspouts to the back of the lot. In May of this year, the City of ********** notified me that the discharge of the downspouts to the rear of the property were in violation of the city building code and ordered me to correct the violation.

      Since Dwyer is the one that created this situation, I have asked them to make the necessary correction.

      Their response has been: 1) the former owner reviewed and approved the work that was carried out, and 2) that the work "had been performing sufficiently for 8 years until we were notified that an inspector flagged the discharge." They further assert that "We were under the impression that the discharge was installed to code, referencing discharges allowed to surface exit if they are 10 feet away from adjacent properties."

      As such, they propose to charge me over $8,000 to perform the correction work.

      My assertion remains since they are the ones who created this situation, they are responsible to correct it - at no cost to me.

      Note that I have also now paid the city $113.40 in abatement fees - I'd like them to reimburse me for those charges as well.

      I choose the Dwyer company to correct a bowing basement wall issue. The first meeting I had with Tony B***** from Dwyer, was followed by a second meeting due to a need for a structural engineering report. Both ***es I had it explained by me how the basement floor would have to be jack hammered, steel pilaster would be set and concreted. There is an existing water diversion system and I was repetitively told that it would most likely be destroyed but would not be necessary after the remaining wall waterproofing was done. The es***ate was submitted after the second meeting. Along with phone conversations, I arranged a third meeting to go over the details again before I signed any contracts, partly because the home is not my primary residence and I needed a clear understanding of what would be done because I would rarely see the project. I RECIEVED NO CONTACT WITH THE DWYER COMPANY during the project that was not initialed by me and I NEVER AUTHORIZED any alteration of the work after I signed the contract. . At the completion of the work I WAS SHOCKED, to find out that instead of jack hammering and concreting in pilasters Dwyer altered the work with out my permission! Their excuse being to preserve the existing water remittance system that they knew about from the first visit, long before the es***ate. I was obviously much less of a job to use concrete screws to support pilasters rather that to "concrete in" after jackhammering. I seems like a "bait and switch" situation with the billing. Dwyer altered the work, out of contract, but wants to be paid by contact. I also have a situation where I feel that T B***** forced me to use ** *********** for supplemental work that was needed. I feel that I had es***ate issues which each that when I questioned Dwyer and the contractor supported the other ones es***ate as to the work that would be required. I think billing is questionably done. I have a separate complaint on ** *********** about an additonal billing issue.
