    My husband and I rented a 2 bedroom apartment from this company at *********** ***** in ******. We had issues there from week 1 with our apartment flooding from the windows not being properly sealed. It took about a week to “fix” but still had minor leaks every now and then. We were told multiple times this is an old building and there will be problems. However, the building itself was not the problem it was the construction of it all. The main hallway flooded every time it rained so we had walk thru puddles of water to get into our apartment from the main hallway (in the 9 months we were there it was never fixed and to my knowledge still isn’t fixed). We had multiple fuses blow that was never properly fixed. Our patio door took months to have fixed, we had to keep our heat on around 80 at night because the patio door wouldn’t close all the way during the winter and they never fixed it until almost spring time. After months of problems here we decided to start looking at houses, we found one and broke our lease early. Prior to all of this my husband ****** had a verbal discussion with the owner ****** about breaking our lease early and if we would get our security deposit back because if it was going to be a problem we would find a way to finish out the lease so we got our deposit back. She told him it won’t be a problem. Well now they are keeping our deposit and won’t give it back because we told our neighbor who broke their lease at the same time as us because they had mold issues for months that was never fixed. I have an email from the property manager, ********* who is ******s sister apologizing on ******s behalf for speaking outside of the contract admitting that we would get our deposit because but now they aren’t. I would never recommend anyone renting from this company, if you need something fixed you will be waiting weeks or months. We just want them to do what’s right and give us our security deposit back.

    ARK Restoration was the company who built the building but doesn't have anything to do with the upkeep and maintenance.

    I am rejecting this response because:

    It’s owned by the same person, ******. If ark doesn’t have anything to do maintenance then why was it always ark people fixing the problems? This is just your way of trying to get out of something you know you’re in the wrong for. We’ll be glad to take this to court along with the other ex tenants we’ve been in touch with since we all left.

    ARK Restoration & Construction does not own the building, therefore the response surrounding the security deposit cannot be answered by ARK Restoration & Construction.  ARK is contracted by the owners of the building to perform maintenance work in the building.  ARK suggests that Mr. ****** refer to his lease for the information of the entity that owns the building.

    I am rejecting this response because:

    I can’t find it on the lease, so please enlighten me on who owns the building? Is it this ”*********** ****** *******” where ****** *********** is listed as the owner? Same owner of Ark? There’s no official business listed as *********** ****** *******. I don’t understand why you guys have to be so sketchy on everything. Just own it, ****** messed up by telling us we will get our deposit back (we have proof in an email from her sister *********). We’re even willing to even compromise on the deposit but you guys aren’t budging at all saying it’s our fault so, we’ll handle it from here then.
