    This complaint is Complaint against James Musacchia and James Musacchia Construction company for failure to return a full deposit on cancelled services.
    James Musacchia was contacted by Dian ******** on October 20th, 2022, and correspondence continued through January 17th at which notice of cancellation was provided. As of January 26th, the $4,000.00 deposit has not been returned to Dian ********. Summary of correspondence is provided in second document. Jennifer contacted James Musacchia on January 12th in a good faith attempt to finish the project on behalf of Dian. James responded over the next few days sporadically and without complying with due dates which continued to delay the project beyond reason. Cancellation of the services quoted by and between James Musacchia Construction and Dian ******** (by Jennifer Petersen POA) were made on January 17th, 2023 and Dian ******** requested the $4,000 deposit to be returned by January 23, 2023, however James Musacchia is not responsive and has failed to provide the refund and failed to provide services. The request of the refund is a result of James Musacchia Construction’s failure to provide a contract prior to accepting and cashing the deposit, failure to negotiate in good faith, failure to respond to deadlines and requests, failure to start construction and failure to show up on scheduled workdays, and failure to hold the deposit in escrow until services are provided. These failures have resulted in unjust enrichment. We are further concerned that other elderly individuals seeking home renovations are receiving the same treatment.
    James Musacchia Construction was notified by email, text and certified mail on January 17th that should James Musacchia Construction choose to not refund the deposit by or before January 23, 2023, Dian ******** would contact the A******* ******* ***** ** ***** ******** ********** ******* ** ** ** ***** ******* **** ****** ********* **** ***** *** ****** ******** ****** ** *******
